Who can file a wrongful death claim in Nevada

Nevada law (NRS 41.085) specifies who has the legal right to file a wrongful death claim. Understanding whether you have standing is one of the first questions to resolve.

Nevada law gives the claim to the deceased’s heirs, the people who would inherit under Nevada’s intestate succession law, and to the personal representative of the estate. Depending on who survived, that can include:

  • Spouse of the deceased
  • Children of the deceased
  • Parents of the deceased, when they are the ones who would inherit
  • Estate representative (personal representative or executor) on behalf of the estate

Standing turns on who would inherit under Nevada’s intestate succession law rather than on how close the relationship was, which is why unmarried or common-law partners, blended families, and similar situations need careful analysis. If you’re unsure whether you qualify, that’s something we can clarify during a consultation.

Common causes of wrongful death in Boulder City

Wrongful death claims arise when someone dies due to another party’s negligence or reckless behavior. Boulder City sits along the US-93 and US-95 corridors, which carry heavy commercial truck traffic and a steady flow of tourists heading to Hoover Dam and Lake Mead. That mix of vehicles and unfamiliar drivers contributes to fatal accidents in the area.

Motor vehicle accidents: US-93 through and around Boulder City carries a mix of local traffic, commercial vehicles, and tourists. High-speed collisions on this corridor, particularly involving drivers unfamiliar with the route, account for many fatal accidents. Fatal car accidents are among the most common wrongful death cases we handle.

Truck accidents: US-93 and US-95 are major commercial routes. Fatal truck accidents involve federal regulations, commercial insurance policies, and corporate defendants. The size and speed of commercial vehicles on these corridors means collisions are disproportionately likely to be fatal.

Pedestrian and bicycle accidents: Within Boulder City, pedestrian traffic along Nevada Way and near the historic downtown area creates risk when drivers fail to yield or are distracted. Tourist traffic unfamiliar with the area compounds the danger.

Medical negligence: When a healthcare provider’s error leads to a patient’s death, the surviving family may have a wrongful death claim against the medical provider. These claims do not run on the general two-year wrongful death clock: under NRS 41A.097, for a death occurring on or after October 1, 2023, the action generally may not be commenced more than three years after the date of injury or two years after the plaintiff discovers, or through reasonable diligence should have discovered, the injury, whichever occurs first. These cases require careful analysis of medical records and expert testimony, and the complaint must include the medical expert affidavit required by NRS 41A.071 or the district court must dismiss it without prejudice.

Premises liability: Fatal injuries from falls, structural failures, inadequate security, or other dangerous property conditions can give rise to wrongful death claims against property owners or managers.

Recreation-related accidents: Lake Mead National Recreation Area and the surrounding trails and waterways draw visitors year-round. Who can be held responsible for a fatal accident there takes work to answer. Under NRS 41.510, an owner, lessee or occupant of premises owes no duty to keep them safe for entry or use for a recreational activity, or to warn of a hazardous condition, and the statute lists camping, hiking, sightseeing and water sports among those activities. That protection does not cover a willful or malicious failure to guard or to warn against a dangerous condition, an injury where permission to take part was granted for a consideration other than any consideration paid to the landowner by the State or one of its subdivisions, or an injury caused by someone given permission to take part, to another person the owner owed a duty to keep the premises safe for or to warn. Where the place is federal, a claim against the United States runs on the Federal Tort Claims Act rather than on the Nevada period described below: the claim has to be presented in writing to the responsible federal agency within two years after it accrues, and suit has to be begun within six months after the agency mails notice of final denial (28 U.S.C. 2401(b)); presenting that claim is a prerequisite to suit, and if the agency does not finally dispose of the claim within six months the claimant may treat that as a denial and sue (28 U.S.C. 2675(a)). Have a lawyer look at where the accident happened and who controlled that place before assuming who can be sued.

Compensation available in Boulder City wrongful death cases

Nevada wrongful death claims can involve two separate categories of damages, sometimes described as the “two checkbook” system under NRS 41.085.

Damages available to the deceased’s heirs may include damages for the pain, suffering or disfigurement of the deceased, which Nevada’s wrongful death statute places with the heirs rather than the estate, along with:

  • Loss of financial support the deceased would have provided
  • Loss of companionship, comfort, and guidance
  • Grief and emotional suffering of the surviving family
  • Loss of household contributions and services

Damages recoverable by the estate may include:

The distinction between a wrongful death claim and a survival action matters because they compensate different losses and may involve different parties. This is something Jack’s team evaluates from the start to ensure nothing is missed.

Every case is different. The potential value of a wrongful death claim depends on the circumstances of the death, the deceased’s age and earning capacity, the family’s relationship to the deceased, and the strength of the evidence. You can explore how these factors interact using a wrongful death settlement calculator, but any real estimate requires a case-specific evaluation.

Nevada’s statute of limitations for wrongful death

You generally have two years after the cause of action accrues to file a wrongful death lawsuit in Nevada (NRS 11.190(4)(e)), but different deadlines and exceptions can apply. An action for injury or death against a provider of health care, based on alleged professional negligence, professional services rendered without consent, or an error or omission in practice, runs instead under NRS 41A.097, which for a death occurring on or after October 1, 2023 allows no more than 3 years after the date of injury or 2 years after the plaintiff discovers, or through reasonable diligence should have discovered, the injury, whichever comes first. A tort claim against the State or one of its political subdivisions must also be filed with the Attorney General or that governing body within 2 years after the cause of action accrues (NRS 41.036), a separate claim-filing requirement that is not a condition precedent to bringing an action. And the period does not run while a person entitled to bring the action was under 18 or insane when the cause of action accrued (NRS 11.250). Do not assume one of these applies to your family; ask an attorney which deadline governs your claim.

Two years may sound like a long time, but critical evidence can disappear much sooner. Surveillance footage, accident scene conditions, and witness availability all deteriorate over weeks and months. Preserving evidence early strengthens your case significantly.

Steps to take after losing a loved one

The legal process is probably the last thing on your mind right now. But there are steps that protect your family’s rights:

Preserve any evidence from the accident or incident. If you have access to photos, dashcam footage, communications, or documents related to what happened, keep them safe. Do not discard or delete anything.

Request official reports. For vehicle accidents within Boulder City, request the accident report from the Boulder City Police Department. For accidents on US-93 or US-95 outside city limits, Nevada Highway Patrol may have handled the report. For incidents on someone’s property, ask for the written incident report from the property owner or manager.

Do not speak with the at-fault party’s insurance company without an attorney. Insurance adjusters may contact you quickly, sometimes within days. They may sound sympathetic, but their goal is to minimize the payout. Your response: “My attorney will be in contact with you.”

Keep records of all expenses. Funeral costs and the medical bills your loved one incurred before death are recoverable through the personal representative’s claim on behalf of the estate. Keep records of your own travel and time away from work as well, so nothing is missed when we evaluate your family’s claim. Document everything.

Consult an attorney before making any decisions about settlements. An early settlement offer from an insurance company may not reflect the full value of a wrongful death claim, especially before the losses have been investigated. Once you accept and sign a release, you cannot pursue additional compensation from that party, even if claims against other responsible parties are still open. Fault is part of what an offer is worth: under NRS 41.141 the claim survives as long as your loved one’s negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing, and the award is then reduced in proportion to that share.

When you are ready to talk

You do not have to understand survival actions or executors before you reach out. When you are ready, tell us what happened, and Jack will explain what may be available under the facts and what would come next. No pressure, no obligation, no cost.

Why you need an experienced Boulder City wrongful death attorney

Wrongful death cases are more complex than most personal injury claims. Multiple parties may share liability. Insurance companies fight harder on high-value claims. The legal process involves both the wrongful death claim itself and, in many cases, a separate survival action on behalf of the deceased’s estate.

If the deceased was the family’s primary earner, accurately calculating lifetime lost income requires economic analysis. If medical negligence was involved, expert testimony is essential. If the family includes out-of-state executors, there are additional procedural considerations.

Jack Bernstein has handled personal injury and wrongful death cases for over 40 years. He is personally involved in every case his firm handles, and his focus on personal injury means your case gets the depth of experience it requires. Beyond wrongful death claims, the other injury cases we handle in Boulder City include car, truck, and motorcycle collisions and falls on unsafe property.

Who can file a wrongful death lawsuit?

Under Nevada law (NRS 41.085), a wrongful death claim can be brought by the deceased’s heirs and by the personal representative of the estate. Heirs are the people who would inherit under Nevada’s intestate succession law, so whether a spouse, child, parent, or other relative qualifies depends on who survived. If you’re unsure whether you have standing, this guide on determining legal heirs may help, and we can clarify your specific situation during a consultation.

How long do I have to file?

Nevada’s statute of limitations for a wrongful death action is generally two years (NRS 11.190(4)(e)), but different deadlines and exceptions can apply: a death caused by a health care provider runs on the different clock in NRS 41A.097, which is not measured from the date of death, a tort claim against the State or a political subdivision must also be filed with the Attorney General or that governing body within two years after the cause of action accrues, though that filing is not a condition precedent to suing (NRS 41.036), and the period does not run while a person entitled to sue was under 18 or insane when the claim accrued (NRS 11.250). However, key evidence can deteriorate or disappear much sooner. Contacting an attorney early helps preserve the strongest possible case.

How much is a wrongful death case worth?

There is no standard answer. The value depends on the deceased’s age, earning capacity, the family’s financial dependence on them, the circumstances of the death, and the available evidence. We evaluate your specific situation during a free consultation and give you an honest assessment.

How long do wrongful death cases take to resolve?

It varies. Some cases settle within months. Others, particularly those involving corporate defendants or disputed liability, can take a year or longer. Jack will give you a realistic timeline based on the specifics of your case.

How much does it cost to hire Jack Bernstein?

Nothing upfront. We work on a contingency fee basis, meaning no attorney fees unless we successfully resolve your case. We advance all case expenses. Your initial consultation is free.

“I don’t even know where to begin, or what to say. Jack and his team went above and beyond anything I could’ve ever expected. My family and I went through a truly horrid experience dealing with the tragic and sudden loss of my kids mother. The last thing we wanted to do was deal with the issues that followed, and I am not a fan of dealing with attorneys, or any of that type of thing. I reached out to Jack’s firm after a recommendation from a friend. Jack called me himself, and assured me he would guide me, and handle everything personally, every step of the way. He made himself available to me via his cell phone at any time day or night. He met me on my level, and made me feel comfortable talking to him, and listening to him. This was way more then just about the settlement, it was about the loyalty, his willingness to go the extra mile, keeping me calm when I didn’t want to be, being fully transparent, and making good on every aspect of his word he gave me and my family when this started. Yes he was able to win my kids a nice settlement, beyond anything we thought possible, but what mattered to us was Jack the man, and THAT is the reason I would never go to anyone else. 5 stars doesn’t do justice to what Jack and his team meant to my family.”
