Jack G. Bernstein, Esq. has been protecting the rights of injured victims and their families for over 40 years.
Speak to Jack about your caseI was hit head on by a drunk driver. I should not be here today. My injuries were so terrible and disfiguring that I thought my life was over. I have never thought to go after another person for insurance money but due to the time I had to miss from work and the needs of my children as a single mom, I had no choice. I called Jack Bernstein and was given his cell phone. I felt like family. Jack took the time on a vacation to call me and understand every aspect of my accident and case. I then was introduced to another attorney in his firm, Hayley Price, who assured me I was in good hands and kept me on schedule with all of the details of my case. She was absolutely wonderful and took my calls at all hours of the day. I cannot say enough about Erika, the supervisor! She went above and beyond to make sure that my children and I were taken care of. I just really can’t say enough about her! She kept me updated and also took my calls all the time. She also provided her cell phone! If I could give more stars I would! I was awarded my check for my injuries and feel like this was so painless, especially after my accident! I needed a WIN and Jack Bernstein and his team delivered! Thank you from the bottom of my heart! Many Thanks, Brittany and Kids!

Understanding Drunk driving accidents
Drunk driving accidents are tragically common and particularly destructive. Unlike other traffic accidents that might result from simple human error, these incidents are entirely preventable and are the result of a driver’s conscious decision to get behind the wheel while impaired. In Nevada, driving under the influence (DUI) is a criminal offense and carries severe penalties. However, the legal consequences for the drunk driver often do little to alleviate the physical, emotional, and financial burden faced by victims.
Common injuries in Drunk driving accidents
Drunk driving accidents often lead to serious injuries due to the impaired driver’s reckless behavior. Victims may suffer from a wide range of physical trauma, including:
- Traumatic brain injuries (TBI)
- Spinal cord injuries
- Snapped bones
- Internal injuries
- Cuts and lacerations
- Whiplash
In addition to physical injuries, many victims experience long-lasting psychological effects such as post-traumatic stress disorder (PTSD) and anxiety. Recovery can be extensive and costly, often requiring surgery, therapy, rehabilitation, and significant time away from work.
Given the devastating impact of these accidents, the next critical step is understanding who can be held liable and how to pursue rightful compensation.
Liability in Drunk driving accidents
Identifying the liable parties in a drunk driving accident is crucial for securing compensation. Naturally, the drunk driver is often held accountable for the crash. However, there are instances where other parties can be held liable as well.
Whether anyone besides the driver can be pursued depends on the facts, including who provided the alcohol and the circumstances in which it was served. Sorting that out is vital in ensuring all liable parties are held accountable.
What to do after a Drunk driving accident
After being involved in a drunk driving accident, it’s crucial to take immediate action to protect your health, rights, and potential legal claim:
Seek medical attention
Contact law enforcement
Document the incident
Avoid discussing fault
Contact a personal injury lawyer
If you would like to talk it through
The police report matters a great deal when the other driver was impaired, and you do not have to chase it down yourself. Tell us what happened and we will tell you honestly whether it is a case worth bringing, and what would come next.

Yes, even if the drunk driver had no insurance, you still have options. You could potentially make a claim against your own uninsured motorist coverage, if you have it. Our law firm can help explore all avenues of compensation.
How does a drunk driving accident affect my car insurance rates?
Generally, if you’re not at fault for the accident, it should not increase your insurance rates. However, every insurance policy is different, and it’s best to consult with your insurance company or a knowledgeable attorney.
What happens if the drunk driver flees the scene of the accident?
Hit-and-run accidents, even those involving drunk drivers, can complicate your claim. However, it’s crucial to report the accident to the police and your insurance company. You can also seek legal assistance to explore your options for compensation.
How can I prove the other driver was intoxicated?
Evidence such as police reports, witness testimonies, and breathalyzer or other chemical tests can help prove that the other driver was intoxicated. A skilled attorney can help gather and present this evidence.
How long do I have to file a claim after a drunk driving accident?
In Nevada, the statute of limitations for personal injury cases, including drunk driving accidents, is generally two years from the date of the accident. It’s crucial to start the legal process as soon as possible to preserve evidence and witness testimony.
How can an attorney help me in a drunk driving accident case?
An attorney can gather evidence, deal with insurance companies, establish the drunk driver’s fault, and fight for fair compensation on your behalf. They can also represent you in court if necessary.
Can I sue the bar or restaurant that served the drunk driver alcohol?
Usually not. Under NRS 41.1305, a person who serves, sells or furnishes an alcoholic beverage to someone 21 years of age or older is not liable in a civil action for damages caused by that person, and a licensed business and its employees are exempt even where the drinker was underage: the act of serving may not be used to establish proximate cause and does not constitute negligence per se. Nevada is unusual among the states in this, so the claim normally runs against the driver and the insurance available through them. An attorney can identify every party who can actually be pursued.
What are punitive damages and when are they awarded in drunk driving cases?
Punitive damages are awarded on top of compensatory damages to punish the at-fault party and deter others, but ordinary negligence does not support them. In a drunk driving case they come under NRS 42.010, which applies where the defendant caused the injury by driving in violation of Nevada’s impaired driving laws after willfully consuming alcohol or another substance, and which takes the NRS 42.005 limits off the award. In other cases NRS 42.005 requires clear and convincing evidence that the defendant acted with oppression, fraud or malice, and caps the award at three times the compensatory damages, or $300,000 if those are under $100,000.
What can I do if the drunk driver was under the legal drinking age?
The claim against the driver is the same as in any other drunk driving case. Two further routes can exist. If the driver was under 18, the adult who signed that minor’s application for a permit or license is jointly and severally liable with the minor for damages caused by the minor’s negligent or willful driving on a highway (NRS 483.300). And a person who knowingly served the underage driver alcohol, or knowingly allowed the driver to drink on premises they control, can be liable for damages the driver caused, although that liability does not reach a licensed bar or store or its employees acting in the course of business (NRS 41.1305). An experienced attorney can help you understand and navigate these complex legal issues.
Can I still recover compensation if I was partly at fault in the accident?
Yes. Nevada follows a modified comparative negligence rule (NRS 41.141): you can still recover damages as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing. Your compensation is then reduced by your percentage of fault.
