What your case might be worth: understanding compensation
The goal of a personal injury claim is to compensate you for the losses you’ve suffered due to your injury. Here’s what you need to know about the types of compensation available and how your personal injury lawyer pursues your claim.
Types of compensation in personal injury claims
- Medical Expenses: This includes all medical costs related to your injury, such as:
- Emergency room visits
- Hospitalizations
- Surgeries
- Medications
- Physical therapy
- Future medical expenses
- Lost Wages: If your injury has caused you to miss work, you can seek compensation for:
- Missed income
- Future lost earning capacity if you’re unable to return to your job
- Pain and Suffering: Compensation may include:
- Physical pain
- Emotional distress
- Mental anguish
- Loss of enjoyment of life
- Property Damage: Reimbursement for damaged property, such as vehicle repair or replacement.
- Punitive Damages: Where clear and convincing evidence shows the defendant acted with oppression, fraud or malice, NRS 42.005 allows damages on top of your other recovery to punish the wrongdoer and deter similar conduct, capped, unless an exception in the statute or another specific statute applies, at three times your compensatory damages, or $300,000 if those are under $100,000.

At Jack Bernstein Injury Lawyers, we work on a contingency fee basis. This means that you don’t pay any upfront costs or fees. We only get paid if we successfully recover compensation for you. If we don’t win, you don’t pay.
How long do I have to file a claim?
In Nevada, the statute of limitations for most personal injury claims is two years from the date of the injury. However, there are some exceptions:For medical malpractice cases, NRS 41A.097 sets a different deadline: for an injury occurring on or after October 1, 2023, the claim generally may not be filed more than three years after the date of injury or two years after you discover, or through reasonable diligence should have discovered, the injury, whichever occurs first (for an injury between October 1, 2002 and September 30, 2023, the discovery period was one year). If a government entity is involved, you must also file a tort claim with the Attorney General for a claim against the State, or with the governing board of the city, county or other political subdivision, within two years after the cause of action accrues (NRS 41.036); that filing is not a condition precedent to bringing an action. It’s crucial to consult with a personal injury lawyer as soon as possible after your injury; a lawyer can identify the deadlines that apply to your claim and help you meet them.
What if the other party disputes my claim?
It’s common for the other party or their insurance company to dispute liability in a personal injury case. They may argue that you were fully or partially at fault for the incident. This is where having an experienced personal injury lawyer is essential. Your lawyer will gather evidence, interview witnesses, and consult with experts to build a strong case on your behalf. They will skillfully negotiate with the other party and fight for your rights in court if necessary.
Do I need to go to court for my claim?
Many personal injury cases are settled out of court through negotiations between your lawyer and the other party’s insurance company. However, if a fair settlement cannot be reached, your case may need to go to trial.
