Understanding traumatic brain injury (TBI)

Traumatic Brain Injury (TBI) occurs when a person experiences a violent blow to the head or body, resulting in damage to the brain. This can happen due to blunt force trauma, such as hitting the head on a dashboard during a car accident, or extreme acceleration/deceleration causing the brain to slosh within the skull. Immediate medical attention is crucial in such cases.

The severity of TBI symptoms varies based on the extent of the head injury, and the time taken to receive medical care. Symptoms can range from mild to severe, affecting various aspects of a person’s life. The three main areas of symptoms include:

CategorySymptoms
CognitiveMemory loss, difficulty concentrating, brain fogginess
PhysicalHeadaches, dizziness, nausea, vomiting, tinnitus (ringing in the ears), blurry vision, slurred speech, clumsiness, fatigue, seizures, coma, sensitivity to light and sound, sleep disturbances
Emotional and BehavioralDepression, anxiety, paranoia, irritability, emotional outbursts, personality changes

It is important to note that some TBIs may not present immediate major symptoms, while others can have delayed onset symptoms.

Steps to take after head trauma

If you have experienced a significant accident or trauma to the head near Las Vegas, it is crucial to take the following steps:

Seek Immediate Medical Attention:

  • Consult a healthcare professional to assess whether you have suffered a brain injury.
  • Prompt diagnosis and treatment are essential for minimizing long-term complications.

Understand the importance of legal assistance:

  • TBI cases can have long-term consequences on a person’s health, well-being, and financial stability.
  • Seeking legal assistance is vital in protecting your rights, navigating complex legal processes, and pursuing rightful compensation.

Common causes of traumatic brain injury

Traumatic Brain Injury (TBI) can occur as a result of various incidents, often caused by accidents and unforeseen events. Understanding the common causes of TBI can help individuals recognize potential risks and take necessary precautions. Some of the most common incidents that can lead to brain injury include:

Automobile Accidents: Motor vehicle accidents, including car collisions, are a significant cause of traumatic brain injuries. The forceful impact during a crash can cause the head to strike against hard surfaces or experience rapid acceleration/deceleration, resulting in brain trauma.

Motorcycle Accidents: Motorcycle riders are particularly vulnerable to brain injuries due to the lack of protection around them. Even with helmets, the force of impact in motorcycle accidents can result in severe head injuries.

Bike Accidents: Similar to motorcycle accidents, bicyclists are exposed and susceptible to head injuries in collisions with vehicles or falls from bicycles.

Slip and Fall Accidents: Slip and fall accidents, often occurring due to hazardous conditions or negligence, can lead to head trauma if the head strikes a hard surface or experiences a sudden jolt.

Workplace Accidents: Certain occupations carry a higher risk of traumatic brain injuries, such as construction workers who may experience falls from heights, being struck by falling objects, or being involved in machinery accidents.

Sports-related injuries: Sports activities, particularly contact sports like football, hockey, or boxing, pose a risk of head injuries. Impactful blows or falls during sports events can result in concussions or more severe brain injuries.

In Las Vegas, like any bustling city, these incidents are unfortunately not uncommon. The high volume of traffic, recreational activities, and workplace environments increases the likelihood of brain injuries in various situations. It is important to note that the prevalence of these incidents underscores the significance of seeking legal assistance to protect your rights and pursue fair compensation for any brain injury sustained.

Seeking compensation for traumatic brain injury

Suffering a traumatic brain injury (TBI) can result in significant physical, emotional, and financial hardships. Seeking compensation for your brain injury can help address the financial burdens and the cost of the support you need. Here are the types of compensation that may be available to brain injury victims, and why it is important to document each of them:

Medical expenses: Traumatic brain injuries often require extensive medical treatment, including emergency care, hospital stays, surgeries, medications, rehabilitation, and ongoing therapies. Compensation for medical expenses is intended to cover these costs so the financial burden of necessary medical care does not fall to you.

Rehabilitation costs: Brain injuries may require long-term rehabilitation, including physical therapy, occupational therapy, speech therapy, and cognitive rehabilitation. Compensation can help cover these rehabilitation costs, enabling you to regain function and improve your quality of life.

Lost Wages: TBI can result in temporary or permanent disabilities, making it challenging to work or earn a living. Compensation for lost wages aims to reimburse you for the income you have lost due to the injury. This includes both past and future earnings.

Pain and Suffering: Brain injuries often lead to physical pain, emotional distress, and a decreased quality of life. Compensation for pain and suffering seeks to provide financial support for the physical and emotional hardships endured as a result of the injury.

Emotional Trauma: TBI can have a profound impact on a person’s mental and emotional well-being, leading to anxiety, depression, post-traumatic stress disorder (PTSD), and other psychological challenges. Compensation for emotional distress aims to address the emotional toll of the brain injury and help cover the costs of therapy or counseling.

It is important to pursue compensation that accounts for both current and future expenses. The long-term effects of a brain injury may require ongoing medical treatment, rehabilitation, and support services. A brain injury also changes the marriage itself, and a spouse may have a separate claim for loss of consortium. What a claim can actually recover depends on the evidence, on who is responsible, and on the insurance and assets available to pay, so we build the case around what your recovery will require and press for as much of it as the facts will support, allowing you to focus on your recovery and rebuilding your life.

How will Nevada's comparative negligence law affect my brain injury case?

In Nevada, liability-sharing rules follow a modified comparative negligence standard: if you were partly at fault for the accident that caused your brain injury, you can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing. Any damages awarded are reduced in proportion to your share of the fault, and if your share is greater than theirs, you recover nothing. A consultation will help you understand how comparative negligence may impact your specific case.

What damages are available to brain injury victims in Las Vegas, NV?

Brain injury victims may be able to recover various types of compensation, including medical expenses, rehabilitation costs, lost wages, pain and suffering, emotional distress, and reduced quality of life. The exact value of your claim will depend on the specific circumstances of your case.

How long do I have to file a claim if I've suffered a TBI in a Las Vegas accident?

In Nevada, an action for injuries to a person, including a brain injury case, must generally be commenced within two years (NRS 11.190(4)(e)). Different deadlines and exceptions can apply depending on the claim and its circumstances: a claim against a health care provider runs on NRS 41A.097, a claim against state or local government on NRS 41.036, and the period does not run while the person entitled to sue was under 18 or insane when the claim accrued (NRS 11.250). It is crucial to consult with Jack Bernstein Injury Lawyers promptly to ensure you meet the applicable deadlines, and not to assume that an exception applies to you.

Can a loved one file a brain injury claim on my behalf?

Often, but not automatically, and not simply because of the family relationship. Being someone’s spouse, parent or adult child does not by itself give you authority to bring a lawsuit for that person. That authority has to come from somewhere specific, and what a court will require depends on the injured person’s capacity and on the facts. If a family member cannot pursue a claim themselves, call us early so the right person files it, in the right name, and so we can tell you which deadline applies to the claim.

What if a family member died due to a traumatic brain injury? Can I still file a lawsuit?

If a family member has passed away as a result of a traumatic brain injury caused by someone else’s negligence, a wrongful death lawsuit may be available. Nevada gives that claim to the deceased’s heirs, the people who would inherit under Nevada’s intestate succession law, and to the personal representative of the estate, so whether you are the right person to file depends on who survived. Jack Bernstein Injury Lawyers has experience in wrongful death and serious brain injury cases and can help you understand your legal options.

Can I seek compensation if my brain injury occurred at work?

Yes, but the route depends on who is responsible, and two clocks start at the accident. If your brain injury happened on the job, workers’ compensation benefits are generally your exclusive remedy against your employer (NRS 616A.020), you must give your employer written notice as soon as practicable and within 7 days of the accident (NRS 616C.015), and you must file a claim with the insurer within 90 days if you sought medical treatment or missed work (NRS 616C.020). If someone other than your employer or a co-worker is legally liable for the injury, you may also bring a claim against that party, though your compensation is reduced by what you recover and the insurer has a lien on the recovery within the limits set by NRS 616C.215. Speak with a lawyer quickly so none of those deadlines pass.

What if my brain injury was caused by a defective product?

If your traumatic brain injury was caused by a defective product, you may have a product liability claim against the manufacturer, distributor, or retailer. Jack Bernstein Injury Lawyers is experienced with product liability cases and can help you determine your legal options.

What legal recourse do I have if my brain injury was caused by someone else's negligence?

If your brain injury resulted from the negligence of another party, you may be able to recover compensation. A consultation with Jack Bernstein Injury Lawyers can help you pursue a personal injury claim against the insurance company or responsible party, seeking compensation for your medical expenses, lost wages, pain and suffering, and other damages.

How can a brain injury lawyer help me with my case?

Jack Bernstein Injury Lawyers can provide valuable assistance by conducting a thorough investigation, gathering evidence, negotiating with insurance companies, building a strong legal strategy, and representing your interests in settlement negotiations or court proceedings. They will work diligently to pursue any compensation that may be available under the facts and the law, and provide guidance throughout the legal process.

“In January I got hit on the freeway which resulted in my car being totaled and ruptured 3 of spinal discs which I was unaware of at the time. I started looking for an injury lawyer and decided on Jack Bernstein as I didn’t have to pay money up front. The first thing they did was send me to a chiropractor which they had connections with I got 3 appointments they also sent me to radiology to get an MRI about 2 months into my treatment which is when they discovered that I had ruptured 3 spinal discs in my lower back. From there they referred me to pain management where they gave me spinal injections to alleviate some of my pain. The best part about all of this is that I didn’t have to pay out of pocket for anything. My case handler Zulie was incredibly helpful throughout the whole process and helped me to fully understand what was happening with my case as it was happening. Due to help from Jack Bersteins office I was able to get the treatment I needed to make a full recovery, a brand new car, and over $65,000 without paying a dime out of pocket!
