Understanding bicycle accidents

Navigating the complexities of bicycle accidents requires a keen understanding of their unique nature, cyclists face greater exposure compared to pedestrians, resulting in potentially more severe outcomes when incidents occur.

Types of bicycle accidents

Bike rides in Las Vegas can be risky. Busy streets and distracted drivers make accidents more likely. Here are different types of bicycle accidents:

Dooring accidents

Occurs when a vehicle occupant opens a door in a cyclist’s path. High risk in urban areas with parallel parking.

Rear-end collisions

Happens when a vehicle hits a bicycle from behind, often due to driver distraction or misjudging distance.

Cross-traffic accidents

Involve vehicles and bicycles colliding at intersections, commonly due to failing to yield or running red lights.

Pedestrian-cyclist collisions

Occurs on sidewalks or crosswalks, often resulting from confusion over right-of-way or inattention.

Road defects

Caused by poor road conditions like potholes or uneven surfaces, leading to loss of control for cyclists.

Riding against traffic

Involves cyclists traveling against the flow of traffic, increasing collision risk due to unexpected movement.

Left-turn accidents

Occurs when a vehicle making a left turn collides with a cyclist going straight, often due to visibility issues or speed misjudgment.

Right hook accidents

Happens when a vehicle turns right, cutting off a cyclist traveling in the same direction, common in busy city traffic.

Dangers of bicycle accidents

Biking in a busy town that is not exactly adept to sharing the road or having bikers around is a challenge that every cyclist is aware of. But that does not mean that drivers can be negligent.

Getting into an accident can have huge damages, physically and financially.

Things like cracked bone, head injuries, and back/spine injuries are what we most commonly see here in Las Vegas.

Common causes of bicycle accidents in Las Vegas

Bicycle accidents in Las Vegas can happen for many reasons. Here are some of the most common causes of bike accidents:

  • Car Collisions: Cars hitting bikes is a top cause of crashes. Drivers might not see cyclists or misjudge their speed. This is often due to distracted driving or failing to yield.
  • Driver Distraction: Accidents spike when drivers don’t pay attention. Texting, eating, or using GPS can lead them to miss seeing a bicyclist nearby.
  • Failure to yield: Some drivers ignore cyclists’ right of way. They might turn or enter traffic without looking, causing serious accidents.
  • Hazardous road conditions: Cracks, potholes, and debris create danger for riders. Poorly maintained streets are a big problem in Las Vegas.
  • Low visibility: At night or during bad weather, it’s harder for drivers to spot bicycles. Riders without lights or reflective gear are at risk.
  • Riding against traffic: Cyclists going the wrong way face more danger. They may surprise drivers who aren’t looking for them there.
  • Not using hand signals: Without signals, others can’t tell what a rider plans to do next. This confusion could end in an injury.

Las Vegas presents unique challenges for cyclists:

High traffic volume

Especially on the Strip and major roads, the sheer number of vehicles increases the likelihood of accidents.

Distracted tourists

Tourists who are unfamiliar with local traffic laws or who are simply not paying attention can be a hazard for cyclists.

Fast-moving traffic

High speeds on multi-lane roads leave cyclists with less time to react and can result in more severe injuries.

Hot weather

Extreme heat can lead to fatigue and dehydration for both cyclists and drivers, increasing the chances of errors.

Tourist impact on bicycle accidents in Las Vegas

Las Vegas also brings a steady stream of tourists, which adds to the bicycle traffic. This constant flow can lead to more accidents on the roads. Many visitors are not used to our local cycling laws or the layout of our streets and bike lanes.

They might not see a stop sign or know which way to look for oncoming cars.

Rental bikes make it easy for tourists who don’t regularly ride to hop on two wheels. These inexperienced cyclists share paths with seasoned locals, increasing everyone’s risk of getting hurt.

Rented e-bikes and stand-up scooters ride in the same traffic, and a crash on one raises questions a pedal bike does not: how fast the motor was pushing you, who owned and maintained the machine, and what the rental app’s terms say. Those claims are covered on the e-bike accident and electric scooter accident pages.

When riders unfamiliar with Nevada’s biking rules join heavy road traffic, chances of collisions go up. It’s critical for bicyclists and drivers alike to stay alert and follow the law.

With so many tourists from all over using bicycles (especially rentals), Las Vegas sees lots of biking incidents that need legal action. If you’re caught in one, knowing your rights is key, and so is finding an attorney familiar with bicycle-specific laws and regulations in Nevada.

For tourists, it is crucial that they seek local legal help if they are a part of a bicycle accident. Tourists face a unique set of challenges that locals don’t, and those can certainly impact the case.

Nevada’s specific reporting requirements

The 10-day DMV crash report

If a crash causes bodily injury, death, or apparent property damage of $750 or more, each driver involved must send a written or electronic crash report to the Nevada Department of Motor Vehicles (DMV) within 10 days (NRS 484E.070). No report is required if a police officer investigated and the officer’s report lists each party’s insurer, policy number, and coverage dates. That report is confidential and, with narrow exceptions, cannot be used as evidence at trial.

If no report was filed

The duty in NRS 484E.070 runs to the driver of a vehicle involved in the crash, and the section prescribes no penalty of its own for missing the 10 day window. Not filing that DMV report does not end your injury claim, and it is not a reason a cyclist loses a driver’s license. If nothing was filed and no officer investigated, talk to a lawyer about documenting the crash now instead of assuming the claim is gone.

Taking these steps may seem overwhelming, but remember, you don’t have to go through this alone. An experienced Las Vegas bicycle accident attorney can guide you through the process and protect your rights.

Understanding liability in Las Vegas bicycle accidents

Determining who is responsible for your bicycle accident is crucial for your personal injury claim. Nevada operates under a “comparative negligence” law.

Nevada’s comparative negligence law

What it means

Even if you were partially at fault, you can still recover damages as long as your share of the fault is not greater than the combined fault of the parties you are suing.

How it affects compensation

Your compensation will be reduced by the percentage of fault attributed to you. For example, if you are found 20% at fault, your award will be reduced by 20%.

The importance of prompt medical attention

It’s imperative to seek medical attention immediately after a bicycle accident, even if you feel fine. Some injuries, like concussions or internal bleeding, may not have obvious symptoms at first. A doctor’s evaluation is crucial for accurate diagnosis and treatment.

Additionally, medical records serve as vital evidence in personal injury claims. They document the extent of your injuries and the treatment you received, which can be essential when seeking compensation.

The cost of a bicycle accident in Las Vegas

Bicycle accident injuries can lead to substantial financial burdens. These costs can include:

Medical expenses

Hospital stays, surgeries, medications, physical therapy, and ongoing care can quickly add up.

Rehabilitation costs

Depending on the severity of your injuries, you may need extensive rehabilitation to regain mobility and function.

Lost wages

If your injuries prevent you from working, you may lose income during your recovery.

These costs can vary significantly depending on the specific injuries and the individual’s needs.

Long-term consequences

Some bicycle accident injuries can have long-term or even lifelong consequences. These may include:

  • Chronic pain
  • Disability
  • Ongoing medical care
  • Reduced quality of life

Emotional and psychological impact

The emotional and psychological trauma of a bicycle accident should not be underestimated. Many victims experience:

  • Anxiety
  • Post-traumatic stress disorder (PTSD)
  • Depression

Seeking support from mental health professionals, support groups, or therapy can be crucial for recovery.

Understanding the potential consequences of a bicycle accident highlights the importance of protecting your rights and seeking legal help to pursue fair compensation.

Dealing with insurance companies after a bicycle accident

After a bicycle accident, dealing with insurance companies can be a daunting task. It’s important to remember that insurance companies are businesses with a primary goal of protecting their profits. This means they may try to minimize payouts or even deny claims altogether.

Insurance companies and their tactics

Insurance adjusters are skilled negotiators who may use various tactics to reduce the amount they pay out. Some common tactics include:

Lowball settlements

Offering a settlement that is far less than what your case is actually worth.

Blaming the cyclist

Trying to shift blame onto you, even if the evidence clearly shows the driver was at fault.

Delaying the claims process

Dragging out the process in hopes that you’ll get frustrated and accept a lower settlement.

Nevada’s bicycle insurance laws

At-fault state

Nevada is an at-fault state, which means the driver who caused the accident is typically responsible for the damages. However, determining fault isn’t always straightforward, and insurance companies may try to dispute liability.

Minimum insurance requirements

Nevada requires every owner of a motor vehicle registered or required to be registered in the State to continuously carry liability insurance of at least $25,000 for bodily injury to or death of one person, $50,000 for two or more people in one crash, and $20,000 for property damage (NRS 485.185). Those are minimums, not a guarantee that the driver’s policy will cover what a cyclist’s injuries actually cost.

Uninsured/Underinsured motorist coverage (UM/UIM)

This type of coverage protects you if the at-fault driver doesn’t have insurance or doesn’t have enough insurance to cover your damages. It’s crucial for cyclists to have UM/UIM coverage on their own insurance policy.

Why you need a lawyer

Having an experienced Las Vegas bicycle accident attorney on your side can make a significant difference in the outcome of your case. Here’s why:

Level the playing field

An attorney understands the tactics insurance companies use and can protect you from being taken advantage of.

Protect your rights

Your attorney will work to protect your rights throughout the legal process and press for fair treatment.

Fight for fair compensation

An attorney will investigate the accident, gather evidence, and negotiate with the insurance company to pursue any compensation that may be available under the facts and the law. This includes compensation for medical bills, lost wages, pain and suffering, and other damages.

Contingency fee basis

Most personal injury attorneys work on a contingency fee basis, meaning you don’t pay any attorney’s fees unless they win your case. This eliminates the financial risk and makes legal representation accessible to everyone.

How a Las Vegas bicycle accident attorney can help

While you may think you can handle your bicycle accident claim on your own, the reality is that insurance companies and the legal system can be complex and difficult to navigate. Having a knowledgeable and experienced attorney on your side can help you navigate that process and pursue any compensation that may be available under the facts and the law.

Wondering whether you need a lawyer at all?

Plenty of people call unsure whether a bike crash is even the kind of thing a lawyer handles. Tell us what happened and we will tell you honestly whether it is a case worth bringing. If it is not, we will say so.

Questions to ask potential attorneys

When interviewing potential attorneys, consider asking these questions:

Experience

How much experience do you have handling bicycle accident cases specifically in Las Vegas? Local experience can be invaluable, as attorneys familiar with local laws and courts can often navigate the legal process more effectively.

Track record

What is your success rate in handling bicycle accident cases? Ask about past settlements and verdicts to gauge their ability to achieve positive outcomes for their clients.

Fees

How do you structure your fees? Most personal injury attorneys work on a contingency fee basis, meaning you only pay if they win your case. Clarify the percentage they take and any additional costs you might be responsible for.

Communication

How do you typically communicate with clients? How often can I expect updates on my case? Clear communication is essential for a successful attorney-client relationship.

“We are incredibly grateful to Jack Bernstein Injury Lawyers for helping us successfully settle our injury claim with AAA after we were rear-ended while stopped at a traffic light. A very special thank you goes to our case manager, Monique, and our fantastic attorney, Ines. Monique was kind, patient, responsive, and helped keep the case moving while we were dealing with the stress, pain, and medical treatment that followed the accident. She made us feel heard and cared for throughout the process. Ines was absolutely outstanding. She understood the details of our case, advocated strongly for us, and made sure the insurance company was held to the standards required under Nevada law. That mattered a lot to us. Insurance companies do not always make the process easy, but Ines made sure our claim was taken seriously and that AAA could not simply minimize what happened or ignore its obligations. What stood out most was that Monique and Ines treated our case like it mattered. They were professional, compassionate, and persistent, and their work helped bring the case to a successful settlement. We truly appreciate everything Jack Bernstein Injury Lawyers did for us, especially Monique and Ines. We would absolutely recommend them to anyone injured in an accident who needs a team that will fight for them and make sure the insurance company is held accountable.”

“In January I got hit on the freeway which resulted in my car being totaled and ruptured 3 of spinal discs which I was unaware of at the time. I started looking for an injury lawyer and decided on Jack Bernstein as I didn’t have to pay money up front. The first thing they did was send me to a chiropractor which they had connections with I got 3 appointments they also sent me to radiology to get an MRI about 2 months into my treatment which is when they discovered that I had ruptured 3 spinal discs in my lower back. From there they referred me to pain management where they gave me spinal injections to alleviate some of my pain. The best part about all of this is that I didn’t have to pay out of pocket for anything. My case handler Zulie was incredibly helpful throughout the whole process and helped me to fully understand what was happening with my case as it was happening. Due to help from Jack Bersteins office I was able to get the treatment I needed to make a full recovery, a brand new car, and over $65,000 without paying a dime out of pocket! I would highly recommend anyone in a similar situation to hire Jack Bernstein as their Injury Lawyer.”
