Injured in an accident?

Jack’s Got Your Back

Las Vegas Uninsured / Underinsured Motorist Accident Lawyers

Nevada has one of the highest rates of uninsured drivers in the country. Even when drivers carry insurance, many only have the minimum required coverage, often not enough to cover serious injuries.

This reality can leave you facing medical bills and lost wages with nowhere to turn, even when the accident wasn’t your fault.

Your own insurance policy may provide protection through Uninsured/Underinsured Motorist (UM/UIM) coverage, and you may carry it without realising. Except as that section and NRS 690B.035 otherwise provide, a policy insuring against motor vehicle liability may not be delivered or issued for delivery in Nevada unless uninsured vehicle coverage is provided in it or supplemental to it; no such coverage is required in a policy issued to the State or one of its political subdivisions, or where an insured named in the policy rejected it in writing on a form the insurer furnished describing the coverage being rejected (NRS 690B.020(1)). Insurers transacting motor vehicle insurance in Nevada must also offer uninsured and underinsured coverage in an amount equal to the bodily injury limits sold to the insured, though no offer is needed in connection with a general commercial liability policy, an excess or umbrella policy, or another policy that does not provide primary motor vehicle insurance (NRS 687B.145(2) and (5)). So check your declarations page before assuming there is nothing there. Insurance companies often make accessing these benefits difficult.

Don’t accept a quick settlement before understanding all your options. Jack Bernstein Injury Lawyers can help identify all possible sources of compensation, including your own policy benefits you may not realize you have.

The basics: uninsured vs. underinsured

Uninsured motorist (UM)

A driver without any insurance. If they’re at fault in an accident, there’s no insurance policy from their side to handle your damages.

Underinsured motorist (UIM)

A driver whose insurance isn’t sufficient to cover all the damages they’ve caused. This means their insurance may cover a portion, but not the full extent of your costs.

Why it’s essential to understand

Facing an accident with an uninsured or underinsured motorist in Las Vegas means you could be dealing with not only physical recovery but also financial challenges. From escalating medical bills to car repairs and other unexpected expenses, the costs can quickly add up. Knowing where you stand, what you may be able to recover, and how to seek compensation is crucial.

Perspectives addressed

The road is a shared space, and every person on it has a unique perspective. Here are a few ways to view an accident involving uninsured or underinsured motorists:

Victim’s lens

You’re driving safely, minding your own business, when bam! Another driver collides with your car. Upon exchanging details, you learn they either have no insurance or not enough. Now what?

The Uninsured/Underinsured driver

Maybe you’re that driver who had a lapse in insurance or didn’t realize the importance of adequate coverage. What are the potential legal implications, and how can you navigate this tricky situation?

Third-party perspective

Perhaps you lent your car to a friend, only to learn later they were uninsured when they got into an accident. Where does this leave you?

Building and qualifying a case

If you find yourself in an accident with an uninsured or underinsured motorist, several questions may whirl around your head. “Do I have a case?” “What proof do I need?” Let’s address these head-on:

Gathering evidence

Just like any accident, you’ll need evidence. This includes police reports, witness statements, and any proof showcasing the other driver’s insurance status (or lack thereof). Remember, documentation is your best friend in these situations.

Your insurance’s role

Even if the other party doesn’t have adequate insurance, your policy might come to the rescue. If you’ve opted for Uninsured/Underinsured Motorist Coverage, it can be a lifesaver, ensuring you’re not left high and dry.

Potential compensation

Being hit by an uninsured or underinsured driver doesn’t mean you’re out of options. Depending on your situation and evidence, you could be eligible for compensation covering medical expenses, lost wages, pain, suffering, and more.

Understanding insurance limits

In Nevada, like many states, there’s a minimum auto insurance coverage requirement. However, these minimums may not always be sufficient to cover all the damages in a severe accident. As of our last update:

  • Bodily Injury: $25,000 per person and $50,000 per accident
  • Property Damage: $20,000 per accident

But what does this mean for you? If the driver at fault has the bare minimum and the damages exceed these amounts, their policy won’t cover the full extent. Coverage can also sit above that policy, so it is worth checking whether an umbrella policy covers the driver or the vehicle owner. If they’re underinsured, you might find yourself having to foot the remaining bills.

Your own policy: uninsured motorist coverage

Many people are unaware of a vital component in their own insurance policy: the Uninsured/Underinsured Motorist Coverage. This policy acts as a safety net, covering you when the other driver can’t. It’s essential to review your policy details, as the terms can vary. If you carry coverage on more than one vehicle, whether those UM/UIM limits can be stacked into one pool is part of that review. Some aspects to consider:

Coverage limit

Determine how much coverage you have in case of such accidents. It might be worthwhile to consider increasing this if it’s currently at a lower limit.

Claiming process

Understand how to make a claim against your own policy. There might be time limits or specific documentation required.

Challenges in claiming against uninsured motorists

Taking action against an uninsured motorist presents its own set of challenges:

Establishing fault

It’s crucial to prove the other party was at fault, as this directly influences compensation amounts.

Locating assets

If the other party doesn’t have insurance, you might need to look into their personal assets as a source of compensation. This is often a complex process.

Legal hurdles

The legal landscape is intricate when dealing with uninsured motorists. There might be more hoops to jump through, compared to a regular claim.

Knowing these challenges upfront equips you with a clear roadmap of the journey ahead, so you aren’t caught off guard.

Strategies to strengthen your claim

Uninsured and underinsured motorist cases often come with their own set of nuances. Strengthening your claim becomes paramount:

Document everything

From the accident scene, damages, to your injuries, ensure you have a record. Photographs, medical records, and police reports can be invaluable.

Witness statements

If there were any bystanders or witnesses, their accounts can help substantiate your claim.

Stay consistent with medical treatments

A consistent medical record showcasing the extent of your injuries can bolster your claim.

Consult with an attorney early

Engaging with a lawyer early can help you start on the right track. They can guide you through the nuances, helping you make informed decisions.

What's the difference between uninsured and underinsured?

Uninsured means the driver has no insurance. Underinsured means they have insurance, but not enough to cover all the damages.

Can I sue the uninsured driver personally?

Yes, you can pursue a lawsuit against the driver’s personal assets, but it can be a complex process.

How does underinsured motorist coverage work?

If the at-fault driver’s bodily injury coverage is not enough to cover your damages, your own underinsured motorist coverage can pay the amount that exceeds that driver’s limits, up to the limits of your own coverage (NRS 687B.145). Your own limits are the ceiling, so it is worth checking how much coverage your policy carries.

What if I'm hit by an uninsured driver and don't have uninsured motorist coverage?

Check first whether that is really the position. Except as that section and NRS 690B.035 otherwise provide, no policy insuring against liability arising out of the ownership, maintenance or use of a motor vehicle may be delivered or issued for delivery in this State unless uninsured vehicle coverage is provided in it or supplemental to it, and no such coverage is required in a policy issued to the State of Nevada or one of its political subdivisions or where an insured named in the policy rejected it in writing, on a form furnished by the insurer describing the coverage being rejected (NRS 690B.020(1)), so ask your insurer for your declarations page and for any rejection form it holds. If there genuinely is no such coverage, recovery usually depends on a claim against the driver personally, which turns on what the driver actually owns, on whether any other party shares responsibility for the crash, and on any other benefits that apply, including medical-payments coverage on your own policy and your health insurance for the medical bills. Keep in mind that a health plan which pays those bills will often assert a reimbursement claim against anything you later recover, so talk to a lawyer before relying on it.

Why is it essential to document everything after the accident?

Documentation helps establish fault, severity of damages, and can bolster your claim.

Can I trust my insurance company to handle everything if hit by an uninsured driver?

While insurance companies can be of help, a lawyer can review your coverage, deal with the insurer on your behalf, and pursue any compensation that may be available under the facts and the law.

“We are incredibly grateful to Jack Bernstein Injury Lawyers for helping us successfully settle our injury claim with AAA after we were rear-ended while stopped at a traffic light. A very special thank you goes to our case manager, Monique, and our fantastic attorney, Ines. Monique was kind, patient, responsive, and helped keep the case moving while we were dealing with the stress, pain, and medical treatment that followed the accident. She made us feel heard and cared for throughout the process. Ines was absolutely outstanding. She understood the details of our case, advocated strongly for us, and made sure the insurance company was held to the standards required under Nevada law. That mattered a lot to us. Insurance companies do not always make the process easy, but Ines made sure our claim was taken seriously and that AAA could not simply minimize what happened or ignore its obligations. What stood out most was that Monique and Ines treated our case like it mattered. They were professional, compassionate, and persistent, and their work helped bring the case to a successful settlement. We truly appreciate everything Jack Bernstein Injury Lawyers did for us, especially Monique and Ines. We would absolutely recommend them to anyone injured in an accident who needs a team that will fight for them and make sure the insurance company is held accountable.”

“In January I got hit on the freeway which resulted in my car being totaled and ruptured 3 of spinal discs which I was unaware of at the time. I started looking for an injury lawyer and decided on Jack Bernstein as I didn’t have to pay money up front. The first thing they did was send me to a chiropractor which they had connections with I got 3 appointments they also sent me to radiology to get an MRI about 2 months into my treatment which is when they discovered that I had ruptured 3 spinal discs in my lower back. From there they referred me to pain management where they gave me spinal injections to alleviate some of my pain. The best part about all of this is that I didn’t have to pay out of pocket for anything. My case handler Zulie was incredibly helpful throughout the whole process and helped me to fully understand what was happening with my case as it was happening. Due to help from Jack Bersteins office I was able to get the treatment I needed to make a full recovery, a brand new car, and over $65,000 without paying a dime out of pocket! I would highly recommend anyone in a similar situation to hire Jack Bernstein as their Injury Lawyer.”
