Signs of nursing home abuse
Recognizing the signs of nursing home abuse is the first step towards protecting your loved ones. It’s essential to understand that nursing home abuse can take on many forms, physical, emotional, sexual, and financial.
Physical signs of abuse are the easiest to identify, including:
- Unexplained injuries like bruises, burns, or fractures
- Bedsores or pressure ulcers
- Dehydration or malnutrition
- Poor personal hygiene
Other forms of abuse, such as emotional or financial, might be more challenging to spot, but they can be just as harmful. Signs can include sudden changes in behavior, withdrawal, depression, or unexpected financial transactions.
Who’s most at risk of nursing home abuse?
Abuse can occur more frequently amongst residents who are unconscious, immobile, or have limited mobility due to their heightened need for care. Similarly, residents with cognitive impairment, such as dementia or Alzheimer’s disease, are at a higher risk because they may be less likely to report the abuse or may be unaware it’s happening. Proximity to family and friends also plays a role; residents who receive few visitors are more likely to be victims of abuse. None of these factors shifts the blame onto the resident. A nursing home owes its residents reasonable care in the circumstances. Whether a facility met that duty in a particular case is decided on the facts, so a facility is not automatically answerable for every act by a staff member, another resident or a visitor.
Dangers of nursing home abuse
Nursing home abuse can lead to severe physical and emotional consequences. Physically, the abuse can result in injuries, infections, malnutrition, dehydration, and in extreme cases, death. Emotionally, the abused individuals may experience depression, suicidal thoughts, fear, withdrawal, and personality changes. It’s important to understand that the emotional toll can be as detrimental as the physical harm.
Nevada standard of care
The State of Nevada maintains strict regulations for care in nursing homes and similar facilities. These regulations establish a standard of care that nursing homes are expected to uphold. Failure to adhere to this standard can result in a breach of duty of care and can hold the nursing home or healthcare provider liable for any resulting harm. Not every harm in a facility comes from deliberate mistreatment. When a resident is hurt because care was simply not given, through understaffing, missed medication, unattended falls or neglected hygiene, the claim is one of nursing home negligence rather than abuse, and we handle those cases as well.
What if my loved one died as a result of nursing home abuse?
If a loved one has died due to nursing home abuse, the deceased’s heirs and the personal representative of the estate can each bring a wrongful death claim. Heirs are the people who would inherit under Nevada’s intestate succession law, so an attorney confirms who qualifies. The heirs recover their own losses, such as grief and sorrow, loss of probable support, companionship, society, comfort and consortium, along with damages for the pain, suffering or disfigurement of the deceased. The estate recovers the medical expenses the deceased incurred before death, funeral expenses, and any penalties the deceased would have recovered, and the estate’s share does not include the pain and suffering of the deceased.

Often, yes. If a facility fell short of the care the circumstances required and your loved one was harmed as a result, you may have grounds for a claim. Two things decide how and where that claim proceeds, and neither is on the admission paperwork by accident. First, nursing home admission agreements commonly contain a pre-dispute arbitration clause, which may send the dispute to arbitration instead of a courtroom; whether a particular clause applies and is enforceable has to be looked at. Second, if the claim is pleaded as professional negligence against a provider of health care, NRS 41A.071 provides that the district court shall dismiss the action, without prejudice, if it is filed without a supporting affidavit from a medical expert meeting the four requirements the section lists. Bring the admission agreement to your first meeting with a lawyer.
What type of compensation can be received from a nursing home abuse lawsuit?
Compensation in nursing home abuse cases may cover medical expenses, pain and suffering, emotional distress, loss of enjoyment of life, and, where clear and convincing evidence shows the facility acted with oppression, fraud or malice, punitive damages of up to three times the compensatory damages, or $300,000 if those are under $100,000, unless an exception in the statute or another specific statute applies. If the abuse leads to the death of the resident, a wrongful death claim can follow: the deceased’s heirs recover losses such as loss of companionship and support along with the pain and suffering of the deceased, and the personal representative of the estate recovers the estate’s losses, such as medical expenses incurred before death and funeral expenses.
How long do I have to file a nursing home abuse claim?
Deadlines for nursing home abuse claims in Nevada depend on how the claim is framed. The general limit for an action for injuries to a person is two years (NRS 11.190(4)(e)). Where the claim is one for professional negligence against a provider of health care, NRS 41A.097 governs instead and sets a different period, measured from both the date of injury and the date the injury was discovered, whichever comes first, so it can be shorter than two years. Other exceptions can apply as well, including that the period does not run while the person entitled to sue was under 18 or insane when the claim accrued (NRS 11.250). It’s best to consult with an attorney as soon as possible to protect your rights.
How much does it cost to hire a nursing home abuse lawyer?
At Jack Bernstein Injury Lawyers, we work on a contingency fee basis for nursing home abuse cases. This means you pay nothing upfront, and we only get paid if we successfully recover compensation for your case.
What if my loved one is afraid of retaliation if they report abuse?
Retaliation against a resident who reports abuse is illegal. If your loved one fears retaliation, it’s crucial to discuss this with the nursing home management and your attorney. A plan can be developed to protect your loved one, which could involve moving them to a new facility or increasing oversight at their current residence.
