Understanding nursing home Negligence
Nursing home negligence occurs when a facility or its staff fails to uphold the proper standard of care, resulting in physical injury or emotional suffering. Unlike abuse, which is intentional, negligence is often due to carelessness or failure to act appropriately. Common types of nursing home negligence include:
Medical Negligence
Neglectful care
Negligent hiring and supervision
Consequences of nursing home Negligence
The consequences of nursing home negligence can be both far-reaching and severe, affecting the physical health, psychological wellbeing, and overall quality of life of residents. Here are some of the potential consequences:
Physical injuries
Health problems
Psychological distress
Decreased quality of life
These are the painful realities of nursing home negligence, but it’s important to know that there are legal remedies available. At Jack Bernstein Injury Lawyers, we’re committed to seeking justice for victims of nursing home negligence and their families.
Signs of nursing home Negligence
Recognizing the signs of nursing home negligence is the first crucial step toward protecting your loved one’s safety and rights. These signs may appear physically, emotionally, or in the condition of the facility’s environment.
Physical signs:
Unexplained injuries or illnesses
Malnutrition and dehydration
Poor personal hygiene
Emotional signs:
Sudden mood changes
Fear or depression
Environmental signs:
Poor hygiene in the facility
Unsafe or unsanitary living conditions
The law on nursing home negligence
Nursing home residents are entitled to respect, dignity, and an appropriate standard of care. Both federal regulation and Nevada’s licensing rules set requirements for the facilities that care for them.
Rights of residents: Most nursing homes take part in Medicare or Medicaid, and the federal regulation that applies to those facilities, 42 CFR 483.10, sets out the rights of their residents. It gives a resident the right to a dignified existence and to be treated with respect and dignity, which includes the right to be free from physical or chemical restraints imposed for discipline or convenience and not required to treat the resident’s medical symptoms. It also gives the resident the right to exercise his or her rights without interference, coercion, discrimination or reprisal, to take part in care planning, and to voice grievances to the facility or another body that hears them without fear of reprisal. Nevada has its own licensing requirements for these facilities on top of the federal ones. The federal requirements are enforced mainly through the survey and certification process rather than by suing under the regulation, but a facility falling short of the standard of care can be evidence in a negligence claim, and abuse of a resident can support a claim of its own.
Responsibilities of nursing home facilities: Nursing homes in Nevada are licensed and regulated, and what a facility owes a resident is measured by the care a reasonable facility would give: a safe and healthy environment, competent staff, appropriate medical and personal care, and respect for residents’ rights. Falling short of that can support a negligence claim.
Failure to comply with these obligations could constitute negligence and provide grounds for a legal claim.
What to do if you suspect nursing home Negligence
If you believe your loved one may be experiencing nursing home negligence, taking swift and strategic action is essential. Follow these critical steps to protect their well-being:
Speak with your loved one
Document your observations
Report your concerns
Seek legal advice
Prompt action can prevent further harm and hold negligent facilities accountable.
If this happened to someone you love
You do not have to be certain it is negligence before you call. Tell us what you have seen at the facility, and we will tell you honestly whether it is a case worth bringing and what would come next.

Aggressive representation: We believe in relentlessly advocating for the rights of victims of nursing home negligence. Our lawyers are recognized for their tenacity and resolve in pursuing justice. Whether through negotiation or in court, we pursue compensation for the losses your family has suffered, including medical costs, emotional distress, loss of companionship, and any other damages the facts support. One limit is worth knowing at the outset: if the claim is one against a provider of health care based on professional negligence, NRS 41A.035 caps noneconomic damages, meaning pain, suffering and other nonpecuniary losses (NRS 41A.011), and the 2026 figure is $590,000. Economic losses such as medical costs and lost income are not subject to that cap. We will tell you whether it applies to your case.
Comprehensive legal support: Our dedication to our clients extends beyond just legal representation. We employ a broad network of trusted professionals, such as medical experts and private investigators, to solidify your case. We take care of every facet of your claim, enabling you to focus on healing and recovery, while we tackle the legal intricacies.
No fee unless we win: We firmly believe that everyone deserves superior legal representation, irrespective of their financial status. That’s why our services are offered on a contingency fee basis, you pay nothing upfront. Our payment is contingent on us successfully obtaining compensation for you. This way, you can access high-quality legal counsel without any financial risk.
Types of compensation in nursing home Negligence lawsuits
If your loved one has suffered due to nursing home negligence, they may be entitled to financial compensation. This helps address the harm caused and supports their ongoing recovery.
Forms of compensation:
Medical expenses
Pain and suffering
Cost of future care
Evaluation of damages:
Several factors affect how compensation is determined, including:
- The duration and severity of the negligence
- The physical and emotional toll on your loved one
- Current and anticipated medical care needs
- Overall impact on quality of life
Impact of Negligence severity:
More severe cases often result in higher compensation due to increased suffering, prolonged recovery time, and costlier treatment. These cases also tend to draw closer scrutiny and stronger legal action.
At Jack Bernstein Injury Lawyers, we will investigate your claim and pursue any compensation that may be available under the facts and the law. You don’t have to face this process alone, we’ll fight to hold negligent facilities accountable.

At Jack Bernstein Injury Lawyers, we offer a combination of vast experience, comprehensive knowledge of Nevada law, and a deep commitment to our clients. We understand the complexities of nursing home negligence cases and know how to navigate them. Our dedication to justice is unwavering, and we will fight tirelessly to hold negligent parties accountable.
Can I pursue a nursing home negligence case if my loved one has passed away due to negligence?
In Nevada, a death caused by nursing home negligence can support a wrongful death claim. The claim belongs to the deceased’s heirs, the people who would inherit under Nevada’s intestate succession law, and to the personal representative of the estate, so whether you are the right person to file depends on who survived. These claims can be complex, so it’s essential to consult with an experienced attorney who can guide you through the process.
What is the average timeline for a nursing home negligence lawsuit in Nevada?
The timeline for a nursing home negligence lawsuit can vary widely, depending on the specifics of the case. However, in general, it can take anywhere from several months to a few years. While this can be a lengthy process, at Jack Bernstein Injury Lawyers, we work diligently to resolve your case as quickly and efficiently as possible while pursuing any compensation that may be available under the facts and the law.
How can I prove that the nursing home was negligent?
Proving negligence requires evidence that the nursing home failed in its duty of care to your loved one and that this failure directly resulted in harm. This evidence can come in various forms, including medical records, expert testimony, photographs of unsafe conditions, and more. Our team at Jack Bernstein Injury Lawyers is skilled in collecting and presenting this evidence to build a strong case.
Will my case go to trial, or can it be settled out of court?
Many nursing home negligence cases can be settled out of court through negotiations. However, if a fair settlement can’t be reached, we are fully prepared to take your case to trial. Our team has a strong track record in court, and we will fight passionately for your loved one’s rights and pursue any compensation that may be available under the facts and the law.
What if the nursing home claims that my loved one's injuries were just due to old age?
It’s a common tactic for nursing homes to claim that injuries or health issues are due to age rather than negligence. However, old age is not an excuse for neglect or substandard care. We’ll help gather evidence to show that the injuries were a result of the nursing home’s negligence, not just a normal part of aging.
How much does it cost to hire Jack Bernstein Injury Lawyers for a nursing home negligence case?
We believe that everyone deserves access to legal representation, regardless of their financial situation. That’s why we operate on a contingency fee basis for nursing home negligence cases. This means you don’t pay us any fees unless we win your case. Our initial consultation is also free, allowing you to discuss your case without any financial obligation.
Can I still pursue a case if the negligent act happened a few years ago?
It depends on how the claim is framed and when it accrued. The general limit for an action for injuries to a person in Nevada is two years (NRS 11.190(4)(e)). Where the claim is one for professional negligence against a provider of health care, NRS 41A.097 governs instead: it runs from both the date of injury and the date the injury was discovered, whichever comes first, so learning of the harm late can shorten the time to file rather than extend it. Other exceptions can apply, including that the period does not run while the person entitled to sue was under 18 or insane when the claim accrued (NRS 11.250). It’s important to consult with an attorney as soon as possible to avoid missing the filing deadline.
Jack Bernstein Injury Lawyers is available to help you handle any eldercare negligence claims in the Las Vegas metropolitan area and beyond. Jack Bernstein and his team can offer you personalized service and legal representation.
