Understanding workers’ compensation
Workers’ compensation laws in Nevada aim to protect workers who are injured on the job, ensuring they receive necessary medical care, wage loss coverage, and help with rehabilitation or retraining if needed. These laws apply regardless of whether the employer or employee was at fault. While the legal system is designed to be straightforward, the reality can be complex with issues such as disputes over the nature of the injury, the extent of impairment, and what constitutes reasonable and necessary medical treatment. A deep understanding of these intricacies is crucial for anyone dealing with a workplace injury and pursuing a claim. Workers’ compensation is also not always your only claim. If someone other than your employer contributed to the injury, such as a subcontractor, a property owner or an equipment supplier on a construction or work site accident, you may have a separate third party claim against that party alongside your benefits.
Eligibility for workers’ compensation
Most employees in Nevada are covered by workers’ compensation insurance. This includes full-time, part-time, seasonal workers, and even some volunteers. However, certain types of workers might not be covered, such as independent contractors or domestic workers. To qualify, the injury or illness must have occurred in the course of employment, meaning it happened while you were doing something on behalf of your employer. Navigating these eligibility criteria can be complex, and cases aren’t always clear-cut. It often takes an experienced attorney to interpret these regulations and apply them effectively to individual cases.
The eligibility criteria for workers’ compensation benefits vary depending on the worker’s employment status:
Full-time employees
Part-time employees
Seasonal workers
Types of workers’ compensation benefits
Temporary disability benefits
Permanent disability benefits
Vocational rehabilitation
Death benefits
The process of filing a workers’ compensation claim
Understanding the process of filing a workers’ compensation claim in Nevada is crucial, and two of the steps below carry hard deadlines: written notice of the injury to your employer, on the form the Administrator prescribes, as soon as practicable and within 7 days after the accident (NRS 616C.015), and a claim for compensation filed with the insurer within 90 days after the accident if you sought medical treatment or were off work (NRS 616C.020). The process typically involves:
- Notifying your employer about the injury
- Seeking immediate medical attention
- Filing the claim with the employer’s insurance company
- Following up on the claim
Each step has specific deadlines and requirements, which, if not met, can jeopardize your eligibility for benefits. Throughout this process, disputes may arise about the nature and severity of the injury, the treatment required, and the extent of the disability. An experienced worker’s compensation lawyer can help navigate this process, advocate for your rights, and help resolve any disputes that arise.
Remember, each workers’ compensation case is unique. Factors like the nature of the job, the circumstances of the accident, the type and severity of the injury, and the worker’s health condition and working capacity can influence the outcome of a claim. The complexities and nuances of workers’ compensation law make it vital to have an experienced legal professional by your side.
Disputes and denials in workers’ compensation
Disputes and denials are not uncommon in workers’ compensation claims. They can arise due to a variety of reasons and can complicate the process of securing benefits. Here are some common issues:
Claim denials
Disputes about the extent of injury
Disputes about medical treatment
Disputes about return to work
Permanent disability rating disputes
In addition to the common disputes mentioned above, disputes may arise over issues such as whether the injured worker is ready to return to work or whether a particular kind of treatment is necessary. For instance, an employer or their insurance company might argue that an employee is fit to return to work based on an independent medical examination, even though the worker’s own doctor advises against it. Or, the insurance company might refuse to cover a certain treatment recommended by the worker’s doctor, arguing that it’s experimental or not widely accepted. Successfully resolving these disputes often involves presenting medical evidence, expert testimony, and a detailed argument supporting the worker’s position.

Workers’ compensation is a state-mandated insurance program that provides benefits to workers who suffer job-related injuries or illnesses. These benefits include medical care, compensation for lost wages, and vocational rehabilitation if needed.
What types of injuries are covered by workers' compensation?
Workers’ compensation covers a wide range of injuries and illnesses that occur as a result of your job. This includes sudden injuries like broken bones or cuts, as well as illnesses or conditions that develop over time due to your work environment, such as carpal tunnel syndrome or certain lung diseases.
How do I file a workers' compensation claim in Nevada?
To file a workers’ compensation claim in Nevada, start with written notice to your employer: under NRS 616C.015 you must give written notice of the injury, on the form the Administrator prescribes, as soon as practicable and within 7 days after the accident, and your employer must keep a supply of those forms for employees to use. Seek medical attention and follow all prescribed treatments. Then, if you sought medical treatment or were off work, you must file a claim for compensation with the insurer within 90 days after the accident (NRS 616C.020).
What if my workers' compensation claim is denied?
If your claim is denied, you have the right to appeal the decision. This can be a complex process and may require presenting evidence at a hearing. At Jack Bernstein Injury Lawyers, we have extensive experience handling these appeals and can help you through this process.
What if there's a dispute about the extent of my injury or the necessary medical treatment?
Disputes about the nature of your injury or your required treatment can often be resolved through negotiation with the insurance company. In some cases, you might need to present medical evidence at a hearing. We can help you prepare for and navigate these disputes.
Can I return to work while receiving workers' compensation benefits?
This largely depends on your medical condition and the advice of your doctor. In some cases, you may be able to return to work in a limited or modified capacity. Any changes in your work status should be communicated to the insurance company.
Can I get workers' compensation if the accident was my fault?
Usually yes. Nevada’s industrial insurance does not turn on fault the way a negligence claim does, so simple carelessness on your part does not disqualify you. The statute does list grounds for denying compensation (NRS 616C.230): an injury caused by the employee’s willful intention to injure himself, herself or another, and an injury that occurred while the employee was in a state of intoxication or under the influence of a controlled or prohibited substance, unless the employee proves by clear and convincing evidence that the intoxication or the substance was not the proximate cause of the injury. Compensation can also be reduced or suspended for refusing reasonable treatment. If any of that is being raised against you, it is worth talking to a lawyer, because the causation question is often where these cases are won.
How can a lawyer help with my workers' compensation claim?
A lawyer can help in numerous ways, including ensuring your claim is filed correctly, advocating for you in disputes or denials, negotiating with insurance companies, and pushing for the maximum benefits you’re entitled to. At Jack Bernstein Injury Lawyers, we offer a comprehensive range of services to assist you throughout the process.
What benefits can I receive through workers' compensation?
Workers’ compensation benefits may include medical care, temporary disability benefits, permanent disability benefits, vocational rehabilitation, and death benefits.
Can I sue my employer if I get hurt on the job?
In most cases, workers’ compensation is the exclusive remedy for a workplace injury, meaning you generally cannot sue your employer or a co-worker. The exceptions are narrow: NRS 616A.020 makes those remedies exclusive except as the workers’ compensation chapters themselves provide otherwise. You can still bring a claim against someone other than your employer or a co-worker who is legally liable for your injury, such as a negligent driver or the maker of defective equipment; if you do, NRS 616C.215 reduces your compensation by what you recover, gives the insurer a lien on your recovery within the limits that section sets, and requires that the insurer be notified in writing before the suit is filed. If you believe such an exception applies to you, you should consult with a lawyer.
What if my employer doesn't have workers' compensation insurance?
If your employer doesn’t have workers’ compensation insurance, they are breaking the law. You may still have options for getting compensation for your injuries, such as filing a lawsuit against your employer. An experienced worker’s compensation lawyer can help you understand your options.
How long do I have to file a workers' compensation claim in Nevada?
In Nevada there are two deadlines, and the earlier one is short. Under NRS 616C.015 you must give your employer written notice of the injury, on the form the Administrator prescribes, as soon as practicable and within 7 days after the accident. Then, if you sought medical treatment or were off work, you must file a claim for compensation with the insurer within 90 days after the accident (NRS 616C.020). It’s recommended to report your injury and start the process as soon as possible.
