It’s essential to understand that every situation is unique. The specifics of your accident will significantly influence which party or parties may be held accountable.

Medical expenses

An off-road vehicle, often referred to as an ORV or ATV, includes dirt bikes, dune buggies, UTVs, and more. They’re designed primarily for off-highway use on terrains like dunes, dirt trails, and rocky paths.
I was injured on a rental off-road vehicle. Who's responsible?
If the vehicle was faulty or lacked proper safety equipment, the rental agency could be liable. However, liability might shift based on the rental agreement, your actions, or if another party was involved.
Can I sue if I was hurt on a public trail?
Potentially, but a claim against the managing entity (city, state, or county) is limited by statute. No action may be based on a failure to inspect a street or other public work, facility or improvement for hazards, whether or not there is a duty to inspect, or on a failure to discover a hazard, whether or not an inspection is made (NRS 41.033), or on the exercise or failure to exercise a discretionary function, whether or not the discretion is abused (NRS 41.032). Where a claim can proceed, a tort award arising from recreational use of public land is capped at $200,000 per claimant with no punitive damages (NRS 41.035), and the claim must be filed with the Attorney General or the local governing body within two years after it accrues, though that filing is not a condition of suing (NRS 41.036). Whether a trail maintenance or signage theory is actionable in your case is a question for your attorney.
My friend let me borrow their ATV, and I got injured. Can I file a claim?
Yes, but it’s complex. If the ATV was malfunctioning and your friend was aware, they might be liable. However, personal relationships can complicate the claim process.
How do I determine the value of my claim?
Claim value depends on medical expenses, lost wages, pain and suffering, and property damage. An attorney can help assess these factors to estimate the worth.
Which off-road rules applied where I was riding?
It depends on the location. Riding near Las Vegas can put you under state vehicle rules, the rules the agency that manages the land has set for the trails you were on, or a city or county park’s own rules, and much of the open desert riding here happens outside city limits. Rather than assume which set applied, we identify the rules for the place you were hurt and whether any of them bear on your claim.
Why should I trust Jack Bernstein Injury Lawyers with my off-road accident claim?
With over four decades of legal experience, Jack Bernstein has an unparalleled understanding of Las Vegas’s legal landscape. Our firm’s commitment is clear: “Jack’s got your back!”
What common mistakes should I avoid after an off-road accident?
Don’t admit fault, always seek medical attention, document everything, and consult with an attorney before speaking to insurance agencies.
Can I claim if the accident was partly my fault?
Nevada uses a modified comparative negligence system (NRS 41.141). You can still claim compensation if you’re partially at fault, as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing. The amount is reduced in proportion to your share of the fault, and if your share is greater than theirs, you recover nothing.
