Rights of victims in Nevada
Two Nevada statutes speak directly to these cases: NRS 11.215, which allows an action for an injury arising from sexual abuse or sexual exploitation that occurred when the plaintiff was less than 18 to be commenced against the alleged perpetrator at any time after it occurred, and NRS 11.217, which does the same for an injury arising from a sexual assault that occurred when the plaintiff was 18 or older. Victims generally have two main avenues of recourse:
Criminal proceedings
Civil suits
Nevada does not put a deadline on the civil claim against the person who committed the abuse. NRS 11.215(1) provides that an action for an injury arising from sexual abuse or sexual exploitation that occurred when the victim was less than 18 years of age may be commenced against the alleged perpetrator, or a person convicted of it, at any time after it occurred. NRS 11.217(1) says the same for a sexual assault that occurred when the victim was 18 or older. NRS 11.190(4)(e), the two year rule for most injury claims, expressly carves out both of those sections. Those two sections speak to the claim against the perpetrator; a claim against a hospital, clinic or employer is not covered by that language, so the timing on that part of a case is different. Given the sensitive nature of these events, talk with an experienced sexual abuse attorney about which deadlines apply to your situation before assuming anything has run out.
Scope of medical professionals subject to legal action
While the term ‘doctor’ often stands at the forefront of medical misconduct discussions, it’s important to understand that any medical professional entrusted with the care and well-being of patients can be held accountable for sexual abuse. This includes, but is not limited to:
Nurses and nurse practitioners
Therapists and counselors
Elder care professionals
Medical technicians
Dentists and dental hygienists
Pharmacists
It’s essential to understand that any misconduct or breach of trust by these professionals, just like with doctors, is not only a violation of personal boundaries but also a grave professional misconduct. Such acts can and should be challenged legally to ensure justice and prevent future incidents.
Common scenarios & red flags
It’s distressing to realize that sexual misconduct can occur even in professional settings. Especially in bustling metropolitan areas like Las Vegas, with its myriad of medical institutions, it’s crucial to be vigilant. Some common scenarios and red flags include:

Reporting and seeking support in Las Vegas
For victims in Las Vegas, it’s paramount to remember you’re not alone, and there are local avenues for support and reporting:

Las Vegas police department

Sexual abuse includes any unsolicited sexual advances, inappropriate touching, invasive procedures without valid reason, or any other form of sexual misconduct in a medical setting.
I faced misconduct at a renowned Las Vegas medical institution. Can I still file a claim?
Absolutely. Regardless of the reputation of the medical institution, you have rights. Jack Bernstein Injury Lawyers have experience handling cases against large establishments and will advocate for your rights.
Isn’t it just doctors who can be held liable for sexual abuse?
No. Any medical professional, whether a doctor, nurse, therapist, or even those in elder care positions, can be held accountable for their actions.
How does Nevada's statute of limitations impact my ability to file a case?
For the claim against the person who abused you, Nevada sets no deadline. NRS 11.215(1) allows an action for sexual abuse or sexual exploitation suffered before the age of 18 to be commenced against the alleged perpetrator at any time after it occurred, and NRS 11.217(1) says the same for a sexual assault suffered at 18 or older. NRS 11.190(4)(e), the two year rule for most injury claims, carves both of those sections out. A claim against a hospital, clinic or employer is not covered by that language, so its timing is different. If you are unsure how the deadlines apply to you, talk with Jack Bernstein Injury Lawyers before assuming it is too late.
I'm worried about my identity being disclosed. How can I maintain confidentiality?
Jack Bernstein Injury Lawyers prioritize client confidentiality. The firm handles case details with sensitivity and discretion.
How can a lawyer help if I was a victim of medical misconduct in Las Vegas?
An attorney not only provides legal advice but can also assist in gathering evidence, representing you in court, and negotiating settlements. Their local experience, especially in Las Vegas, can be invaluable.
Will I need to face my abuser in court?
Not necessarily. Many cases settle outside of court. However, if a trial is necessary, your attorney will prepare and support you throughout the process.
Can I seek compensation even if the abuser isn’t criminally convicted?
Yes. Civil cases have a different burden of proof than criminal cases. You can pursue compensation in a civil court, even if there isn’t a criminal conviction.
How soon should I seek legal advice after an incident?
It’s advisable to seek legal counsel as soon as possible. Early consultation can help preserve evidence and provide clarity on the best steps forward.
