Common hazards in construction zones
While every construction site and roadwork zone differs in specifics, several recurring factors increase the risk of accidents:

Uneven road surfaces
Visual obstructions
Poorly lit areas
Determining fault in a construction zone accident
One of the most pressing concerns for anyone involved in a construction zone accident is establishing who’s at fault. Here are some guiding points:
Negligent drivers
Construction companies and contractors
Equipment manufacturers
City or state agencies
Pedestrian actions
Comparative negligence
Complexities of construction zone accident claims
Construction zone accident claims can be more intricate than typical road accident claims. Here’s why:
Multiple parties involved
Different regulations
Fluctuating conditions
Pedestrians, workers, and other road users
Not just drivers, other individuals can be adversely affected by construction zone hazards:
Pedestrians
Construction workers
Bicycle riders and Motorcyclists
How can an attorney help?

Court representation
Do you have a claim? Points to consider

Construction zone accidents can include collisions due to poor signage, accidents caused by negligent drivers in the zone, incidents involving construction equipment, or any mishap within or near a roadwork area.
I was hit by another driver in a construction zone. Who is liable?
Liability might lie with the negligent driver, but if the construction zone lacked proper signage or had other hazards, multiple parties could share the blame.
The construction equipment malfunctioned and caused my accident. Can I sue the manufacturer?
Yes, if a defect in the equipment played a role in your accident, you could have a claim against the manufacturer or supplier.
I’m a construction worker and was injured on site. Do I have a case?
Often both routes are open, not one or the other. If you were hurt on the job, workers’ compensation is generally your exclusive remedy against your employer (NRS 616A.020): give your employer written notice as soon as practicable and within 7 days of the accident (NRS 616C.015), and file a claim with the insurer within 90 days if you sought medical treatment or missed work (NRS 616C.020). Separately, you may bring a claim against a person other than your employer or a co-worker who is legally liable, such as an equipment manufacturer or a negligent driver, but your compensation is then reduced by what you recover, the insurer has a lien on the recovery within the limits set by NRS 616C.215, and the insurer must be notified in writing before that claim is filed.
How is compensation determined in construction zone accidents?
Compensation factors in medical expenses, property damage, lost wages, pain and suffering, and other relevant costs.
Are construction companies required to follow certain safety standards?
Yes, construction companies must adhere to federal and state safety regulations, ensuring proper signage, barrier placements, and overall site safety.
What should I do immediately after a construction zone accident?
Ensure your safety, report the incident, gather evidence (photos, witness details), seek medical attention, and then consult an attorney.
Why is Jack Bernstein the right choice for construction zone accident cases?
With over 40 years of legal experience, Jack offers direct consultations and an approach built around the facts of your case. He will investigate your claim and pursue any compensation that may be available under the facts and the law.
What if I was partially at fault in the construction zone accident?
Nevada follows a modified comparative negligence rule (NRS 41.141). You can still recover damages as long as your share of the fault is not greater than the combined fault of the parties you are suing, and any award is reduced by your percentage of fault. Because construction zone cases often involve several possible defendants, who is named in the claim affects that comparison.
How soon should I contact an attorney after the accident?
As soon as possible. Quick action preserves evidence, and it leaves time to work out which deadline governs your claim. An action for injuries to a person must generally be commenced within two years (NRS 11.190(4)(e)), but different deadlines and exceptions can apply: a claim against the State or a political subdivision must also be filed with the Attorney General or with that body’s governing body within two years (NRS 41.036), and the period does not run while the injured person was under 18 or insane when the claim accrued (NRS 11.250). Do not assume an exception applies to you.
Navigating through a construction zone is tricky, and if you’ve been in an accident, figuring out the next steps can feel overwhelming. But remember, you’re not alone in this.
