Common locations and scenarios in Las Vegas

The vibrant nature of Las Vegas, characterized by its busy nightlife, multi-lane roads, and extensive parking areas, unfortunately, makes it a potential hub for hit and run incidents. Here are some generalized scenarios and locations where these unfortunate events tend to occur:

Major intersections

Multi-lane roads and busy intersections in Las Vegas are often sites of accidents due to the high volume of traffic and complex navigation. In the chaos, some drivers choose to flee rather than face the consequences.

Nightlife zones

Areas such as the iconic Las Vegas Strip and the bustling Downtown region see a mix of tourists and locals. The dense foot traffic and congested roads, particularly during the late hours, make these areas more susceptible to hit and run incidents.

Parking areas

Large parking facilities, whether associated with shopping malls, casinos, or entertainment venues, are frequently the scenes of minor collisions. Even though these accidents might be less severe, the urge to avoid responsibility leads some drivers to leave without providing their details or ensuring the well-being of others involved.

Understanding Nevada’s hit and run laws

In Nevada, a driver involved in a crash on a highway or on premises to which the public has access has duties at the scene, and being blameless does not excuse them. NRS 484E.010 requires the driver of a vehicle involved in such a crash resulting in bodily injury to or the death of a person to stop immediately at the scene, or as close to it as possible, to forthwith return to and in every event remain at the scene until the driver has fulfilled the requirements of NRS 484E.030, which are giving name, address and the vehicle’s registration number, exhibiting a driver’s licence upon request and if available, and rendering reasonable assistance to anyone injured. Where the crash resulted only in damage to a vehicle or other property that is driven or attended by a person, NRS 484E.020(1) requires the driver to stop immediately and, if the vehicle is creating a hazard or obstructing traffic and can be moved safely, to move it out of the traffic lanes of the roadway to a safe location and then, where applicable, to fulfil the NRS 484E.030 requirements. Which of those sections fits a given crash, and what a driver owes in a situation neither covers, is worth asking a lawyer about.

Specific obligations include:

Exchange of information

Drivers must provide their name, address, and vehicle registration number. If asked, they must also present their driver’s license.

Assistance to the injured

If the accident results in injury, drivers are obligated to provide reasonable assistance, which might include transporting (or arranging transportation for) the injured to a hospital.

Fleeing the scene of an accident, especially one that results in bodily injury or death, can lead to severe penalties in Nevada. These can range from hefty fines to substantial jail or prison time, depending on the circumstances and severity of the accident.

At Jack Bernstein Injury Lawyers, we handle hit and run claims under Nevada law, and we will investigate your claim and pursue any compensation that may be available under the facts and the law.

Steps to take after a hit and run accident

In the immediate aftermath of a hit and run accident, victims often find themselves in a whirlwind of confusion and emotion. Despite this, taking the right steps early can shape how well your claim is documented:

Ensure safety

Move the vehicle to a safe location, if possible, and turn on hazard lights. Check yourself and others for injuries and seek immediate medical attention.

Contact law enforcement

Report the accident to the police promptly, not days later, and give accurate details. Prompt reporting is more than good practice here: NRS 690B.020(3)(f) reaches a vehicle whose owner or operator is unknown or after reasonable diligence cannot be found only where the bodily injury or death resulted from physical contact of that vehicle with you or with a vehicle you were occupying (subparagraph (1)) and the crash was reported within the time the reporting statutes require, to the police department of the city where it occurred or, in an unincorporated area, to the county sheriff or the Nevada Highway Patrol (subparagraph (2)). Reporting is one of those conditions, not the whole of the coverage question, and paragraph (f) is only one of the ways a vehicle counts as uninsured under NRS 690B.020(3). Separately, and except as otherwise provided in its subsections 3, 4 and 5, NRS 484E.070(2) calls for a written or electronic crash report to the DMV within 10 days where a crash on a highway or on premises to which the public has access results in bodily injury to or the death of any person or total damage to any vehicle or item of property to an apparent extent of $750 or more; subsection 3 excuses it where a police officer investigated the crash and the officer’s report records each person’s insurer, policy number and coverage dates. Request a copy of the police report as well, since it helps with the insurance claim and with a lawyer’s review.

Exchange information

Exchange contact, insurance, and vehicle information with the other parties involved in the accident. Collect details such as names, phone numbers, addresses, driver’s license numbers, license plate numbers, and insurance policy information.

Document the scene

Take photos or videos of the accident scene, including the position of vehicles, damage sustained, skid marks, and any relevant road conditions. These visual records can support your insurance claim or legal case.

Gather witness information

If there are any witnesses present, obtain their contact information. Their statements may be crucial for insurance purposes or legal proceedings.

Seek medical attention

Even if you don’t have immediate visible injuries, it’s strongly advisable to get a medical evaluation after an accident. Some injuries may not manifest symptoms right away, and medical records can link any injuries to the accident.

Consult an attorney

If the accident resulted in significant damages or injuries, you should consult with an injury attorney in Las Vegas. The legal experts at Jack Bernstein Injury Lawyers can provide guidance, protect your rights, and assist in seeking compensation for your injuries.

Challenges in hit and run cases and how to overcome them

Hit and run cases come with their own set of unique challenges:

Identifying the at-fault party

Often, the biggest hurdle is tracking down the driver who fled the scene.

Collaborating with authorities

Maintain open communication with law enforcement. Sometimes, working with private investigators becomes necessary to gather more evidence.

Insurance hurdles

If the at-fault party remains unidentified, the claim usually runs through the uninsured vehicle coverage on your own policy, which a Nevada motor vehicle liability policy carries unless the named insured rejected it in writing on a form the insurer furnished (NRS 690B.020(1)), and which pays up to the limits you bought (NRS 687B.145(2)). Pursuing the driver in court, or restitution in a criminal case, needs a driver who has been identified.

What qualifies as a hit and run accident?

A hit and run occurs when a driver involved in an accident, regardless of fault, leaves the scene without stopping to identify themselves or assist the injured.

I didn’t get the license plate number; do I still have a case?

Often yes, but the route to recovery changes. Without a plate number the driver may never be identified, and the claim usually runs through your own uninsured vehicle coverage rather than against the other driver. Nevada’s uninsured vehicle coverage reaches a vehicle whose owner or operator is unknown or cannot be found after reasonable diligence, on two conditions: the injury resulted from physical contact of that vehicle with you or with the vehicle you were in, and the crash was reported to the police within the time the reporting statutes require (NRS 690B.020(3)(f)). Your own policy wording matters too, so have it read. Meanwhile, witnesses, surveillance footage, and physical evidence still matter, both to identify the driver and to prove what happened.

What should I do immediately after a hit and run?

Ensure safety first, then report the incident to the police, gather any available evidence, seek medical attention, and inform your insurance company.

Is it worth hiring an attorney if I have minimal evidence?

Absolutely. An experienced attorney, like those at Jack Bernstein Injury Lawyers, can help unearth evidence you might overlook and navigate the complexities of your case.

How does uninsured motorist coverage help in hit and run cases?

It is usually the route to recovery when the driver is never identified. Start by checking your policy rather than assuming you have no coverage: a Nevada auto liability policy must include uninsured vehicle coverage unless the named insured rejected it in writing, on a form the insurer furnished describing the coverage being rejected (NRS 690B.020(1)). What that required coverage pays for is bodily injury, sickness, disease and death; coverage for your own property damage is a separate product you may or may not have bought. And where the owner or operator is unknown or cannot be found after reasonable diligence, the statute reaches that vehicle only if the injury resulted from physical contact of the vehicle with you or with the vehicle you were in, and the crash was reported to the police within the time the reporting statutes require (NRS 690B.020(3)(f)). Your own policy wording matters too, so have it read.

Can I still get compensation if the at-fault driver isn’t found?

Often, though the route changes and it is not automatic. With no driver to sue, the claim usually runs through your own uninsured vehicle coverage, which a Nevada policy carries unless you rejected it in writing (NRS 690B.020(1)). For an unidentified driver that coverage turns on two conditions in the statute: the injury resulted from physical contact of the vehicle with you or with the vehicle you were in, and the crash was reported to the police within the time the reporting statutes require (NRS 690B.020(3)(f)). Identifying the driver is still worth the effort, because it opens the driver’s own liability coverage. Have a lawyer read your policy and the police investigation to see what is open to you.

How can a lawyer help if the driver remains unidentified?

Lawyers can work with law enforcement, hire private investigators, and handle the claim with your insurance company, which matters in hit and run cases where the driver is never identified.

Are there time limits to report a hit and run or seek legal action in Las Vegas?

Two clocks matter, and the short one is the one people miss. A lawsuit for injuries to a person generally has to be started within two years (NRS 11.190(4)(e)). Long before that, if you need your own uninsured vehicle coverage because the driver was never identified, that coverage depends on the crash having been reported within the time the reporting statutes require to the police department of the city where it happened or, in an unincorporated area, to the county sheriff or the Nevada Highway Patrol (NRS 690B.020(3)(f)(2)). One of those statutes, NRS 484E.030, tells a driver in a crash involving injury, death or a crash on a highway to report it forthwith to the nearest police authority or the Nevada Highway Patrol if no police officer is present. So report the crash right away, and confirm your own deadlines with a lawyer early.

What are the penalties for those who commit a hit and run in Nevada?

Penalties vary based on the severity of the accident but can include fines, jail time, and loss of driving privileges.

I’m just a visitor in Las Vegas and was a victim of a hit and run. Can Jack Bernstein Injury Lawyers still assist me?

“We are incredibly grateful to Jack Bernstein Injury Lawyers for helping us successfully settle our injury claim with AAA after we were rear-ended while stopped at a traffic light. A very special thank you goes to our case manager, Monique, and our fantastic attorney, Ines. Monique was kind, patient, responsive, and helped keep the case moving while we were dealing with the stress, pain, and medical treatment that followed the accident. She made us feel heard and cared for throughout the process. Ines was absolutely outstanding. She understood the details of our case, advocated strongly for us, and made sure the insurance company was held to the standards required under Nevada law. That mattered a lot to us. Insurance companies do not always make the process easy, but Ines made sure our claim was taken seriously and that AAA could not simply minimize what happened or ignore its obligations. What stood out most was that Monique and Ines treated our case like it mattered. They were professional, compassionate, and persistent, and their work helped bring the case to a successful settlement. We truly appreciate everything Jack Bernstein Injury Lawyers did for us, especially Monique and Ines. We would absolutely recommend them to anyone injured in an accident who needs a team that will fight for them and make sure the insurance company is held accountable.”

“In January I got hit on the freeway which resulted in my car being totaled and ruptured 3 of spinal discs which I was unaware of at the time. I started looking for an injury lawyer and decided on Jack Bernstein as I didn’t have to pay money up front. The first thing they did was send me to a chiropractor which they had connections with I got 3 appointments they also sent me to radiology to get an MRI about 2 months into my treatment which is when they discovered that I had ruptured 3 spinal discs in my lower back. From there they referred me to pain management where they gave me spinal injections to alleviate some of my pain. The best part about all of this is that I didn’t have to pay out of pocket for anything. My case handler Zulie was incredibly helpful throughout the whole process and helped me to fully understand what was happening with my case as it was happening. Due to help from Jack Bersteins office I was able to get the treatment I needed to make a full recovery, a brand new car, and over $65,000 without paying a dime out of pocket! I would highly recommend anyone in a similar situation to hire Jack Bernstein as their Injury Lawyer.”
