Jack’s Got Your Back
Las Vegas Mall & Shopping Center Slip & Fall Accident Lawyers
You aren’t just in a “store” you are in a commercially managed property where liability is split between massive real estate investment trusts (REITs), individual tenants, and third-party vendors.
Property management companies often use this complexity as a shield. When you slip in a food court or trip on a cracked parking garage curb, they try to pass the blame to a contracted cleaning crew or a tenant.
With 40+ years of experience as a personal injury attorney, Jack Bernstein knows how to pierce this corporate veil. He knows how mall owners, their tenants and their vendors divide responsibility on paper, and how to look past that at what the owner itself did about a hazard.

Major shopping centers we litigate against
Las Vegas shopping centers fall into distinct categories, each with unique hazard profiles. We handle claims against all major properties:
The “Strip” malls (high tourist traffic)
- Fashion Show Mall Slip and Fall Accidents, Massive atrium spaces and runway events create unique floor hazards.
- The Forum Shops at Caesars Accidents, Spiral escalators and fountain humidity create specific slip risks.
- Miracle Mile Shops Accidents, “Rainstorm” attraction and high-traffic pedestrian connectors.
- Grand Canal Shoppes Accidents: Cobblestone walkways and canal-adjacent surfaces.
Outlet & outdoor centers
- Las Vegas North/South Premium Outlets, Outdoor walkways exposed to weather, heat-damaged pavement, and drainage issues during monsoons.
- Town Square Las Vegas Accidents, Mixed-use roadways where pedestrian walkways intersect with vehicle traffic.
Local & suburban malls
- Meadows Mall Slip and Fall Accidents: Older infrastructure issues involving elevators and flooring transitions.
- Galleria at Sunset Accidents: Food court spills and skylight leaks.
Why “we hired a cleaning company” is not a complete answer
In a typical slip and fall case, a defendant might blame their cleaning company: “We hired a janitor, it’s their fault they missed the spill.”
A shopping center owes the people it invites in a duty of reasonable care to keep the property reasonably safe. Hiring a janitorial or maintenance contractor does not answer the separate question of whether the owner itself acted reasonably, so “the cleaning company missed it” leaves open what the owner did: what its inspection schedule was, whether it supervised the work, and whether it responded once it knew or should have known about the hazard.
Nevada has one narrower rule close to this ground: a property owner who hires security personnel has a personal, non-delegable duty to provide responsible security personnel (Rockwell v. Sun Harbor Budget Suites, 112 Nev. 1217, 925 P.2d 1175 (1996)). That rule is stated in security terms, and no Nevada decision we rely on extends it to cleaning or maintenance vendors, so whether a mall, its contractor, or both answer for a spill is decided on the facts of the case. Ask your attorney about yours. Either way, we identify every entity that may be responsible for your injury, not just a cleaning vendor that may have no assets to pay a claim.
Common mall hazards & liability zones
Liability depends entirely on where you fell. We investigate the specific operational zone of your accident:
1. The Food Court (The “Tray Drop” Hazard) Food courts are the highest-risk zones in any mall. Liability often turns on the difference between a “spill” and a “tray drop.”

The “lease line” trap
3. Parking Garages & Lots Mall garages are notorious for “Wheel Stop” hazards (concrete barriers that are unpainted or misaligned) and Oil Slicks near payment kiosks. Inadequate lighting in garages also creates security risks.
4. Escalators & Elevators Malls rely heavily on vertical transport. Escalator injuries often result from “comb plate” failures (where the steps disappear) or sudden stops. These cases usually involve suing the Maintenance Contractor (e.g., Otis, Kone) in addition to the mall.
Proving negligence: “security vs. safety” sweeps
Malls have security guards patrolling 24/7. But were they looking for hazards or shoplifters?
Jack Bernstein audits the security logs to prove Systemic Negligence.

Frequently asked questions
Have questions about your case?
Every mall & shopping center slip & fall accident case is different. These answers cover the general rules; what applies to you depends on the facts.
Call us any time, 24 hours a day, and we will go through the specifics with you. It is free, and there is no obligation.
(702) 633-3333 Free consultation · Available 24/7 Or send us the details onlineI slipped on a spilled drink in the food court. Is the restaurant or the mall responsible?
Usually the mall. Once food leaves the counter, the common seating area is the responsibility of the mall’s management. However, if the spill was caused by a restaurant employee (e.g., taking out trash), the restaurant may share liability. We investigate both.
How long do I have to file a claim?
For a personal injury claim, Nevada’s statute of limitations is generally two years (NRS 11.190), and different deadlines and exceptions can apply depending on the claim and its circumstances. However, mall security footage is often overwritten in 30 days or less. You must act immediately to preserve the video evidence of your fall.
What if I was shopping and distracted by a window display?
The mall expects you to look at displays, that’s their business model. Under Nevada’s modified comparative negligence rule (NRS 41.141), being distracted by merchandise does not by itself disqualify you: you can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing, with any damages reduced in proportion to your share of the fault. Whether a mall acted reasonably in a setting built to draw a shopper’s eye to the storefronts rather than the floor is a fact question, and a foreseeable distraction is one of the things that bears on it.
Q: The mall manager said they aren’t liable because a “cleaning vendor” caused the issue.
This is a common tactic, and it is not a complete answer. The mall has its own duty of reasonable care, so the question remains whether the mall inspected, supervised and responded reasonably. Whether the mall, the vendor, or both are responsible depends on the facts, which is what an investigation sorts out.
