Understanding the issue: side-impact Collisions unveiled
What is a side-impact or t-bone collision?
A side-impact collision occurs when the front of one vehicle collides with the side of another. Unlike other accident types, the impact is directly on the passenger or driver’s side, often leading to higher chances of severe injuries.
How is it different from other types of accidents?
While rear-end and head-on collisions have their own sets of issues, side-impact accidents are particularly dangerous. In a T-bone accident, there’s usually less vehicle structure to absorb the impact, putting passengers and drivers at greater risk.
Common causes unique to t-bone accidents
- Running Red Lights
- Failing to Yield at Stop Signs
- Driving While Distracted
Each of these actions can have devastating consequences, especially at Las Vegas’ bustling intersections.
When should you contact an attorney: assessing your t-bone collision case
Navigating the legal landscape after a T-bone collision can be daunting, especially when you’re also dealing with the emotional and physical aftermath. Here’s a breakdown of what you should consider to determine whether contacting an attorney like Jack Bernstein is the next logical step.
- Substantial injury: If you or any passenger has suffered significant injuries, immediate legal counsel is recommended. Not only does this increase the stakes, but it also complicates the claim process.
- Clear liability: Was the other driver clearly at fault? If you have evidence such as eyewitness accounts or dashcam footage that validates your claim, you’re in a good position.
- Police report: Always file a police report after a T-bone collision, particularly if you believe you’re not at fault. A detailed police report can be a cornerstone in building your case.
- Insurance issues: If the at-fault party lacks insurance or offers a settlement that doesn’t cover your expenses, this is a clear sign to seek professional advice.
The importance of immediate action:
Time is of the essence, especially if you’ve been injured. Immediate medical attention not only protects your health but also provides crucial documentation that can later serve as evidence. Delaying this could undermine your claim, as insurance companies might argue that the injuries were not severe or not related to the accident.
- Medical expenses: This encompasses everything from immediate hospital care to ongoing medical treatments.
- Property damage: Compensation for the damages to your vehicle, including repairs or the market value of the car if it’s totaled.
- Emotional distress: The mental and emotional toll of the crash can form part of a claim, though it is harder to quantify than a medical bill and takes substantial evidence. What can be claimed depends on your facts, including how the emotional harm relates to your physical injuries.
- Loss of income: If you’ve had to take time off work due to injuries sustained in the accident, this too can form part of your claim.
- Pain and Suffering: This is a more subjective area but still a potential claim, particularly if you have endured significant physical pain or emotional trauma.
Understanding the nuances specific to T-bone collisions, especially within the legal boundaries of Nevada, is essential. The process may seem overwhelming, but an experienced attorney like Jack Bernstein can guide you through each step and help you file a claim built around your circumstances.
Not sure whether you have a case?
You do not have to work that out on your own. Tell us what happened at the intersection and Jack will tell you honestly whether it is a case worth bringing, and what it would need first.

Legal aspects: the specifics of t-bone Collisions in Nevada’s legal landscape
Nevada-specific traffic laws
In Nevada, failing to yield the right-of-way at an intersection or running a red light not only subjects you to fines but can also weigh heavily against you when fault is decided in a T-bone collision. It does not by itself end your claim: under NRS 41.141 you can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing. Understanding local traffic laws is crucial in establishing liability.
Comparative negligence law in Nevada
In Nevada, the law follows a “modified comparative negligence” model (NRS 41.141). This means both parties can be partially at fault in an accident. You can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing, and your compensation is reduced by the percentage you’re found to be at fault. So, for instance, if you’re 20% at fault in a T-bone collision, any compensation awarded to you would be reduced by that percentage; if your share of the fault is greater than the other side’s, you recover nothing.
Damages and compensation
When it comes to T-bone collisions, these are the types of claims you can potentially make:
Economic damages
Non-economic damages
Punitive damages
Importance of evidence
You can’t overstate the importance of collecting solid evidence:

Police reports
Witness statements

How can an attorney help me in a T-bone collision case?
An attorney protects your rights, assesses damages, handles insurance complexities, and offers legal guidance specific to Las Vegas.
What types of damages can I claim?
A claim can cover medical expenses, property damage, and lost wages. Emotional distress may also be part of a claim, depending on your facts and how the emotional harm relates to your physical injuries.
Why are T-bone collisions more dangerous than other types of accidents?
T-bone collisions often occur at high speeds and can result in severe injuries due to the limited protection on the sides of vehicles.
What are common causes of T-bone collisions in Las Vegas?
Common causes include running red lights, failure to yield, and distracted driving.
How does Nevada law specifically address T-bone collisions?
Nevada operates under a modified comparative negligence system (NRS 41.141), so your level of fault affects your compensation: you can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing, with any award reduced in proportion to your share of the fault.
How long do I have to file a claim?
In Nevada, the statute of limitations for personal injury cases is generally two years (NRS 11.190(4)(e)), measured from when the claim accrues, and an action for injuring personal property such as your vehicle generally has three years (NRS 11.190(3)(c)). Different deadlines and exceptions can apply, including that the period does not run while the injured person was under 18 or insane when the claim accrued (NRS 11.250). Ask an attorney which deadline applies to your claim.
What is comparative negligence?
It’s the rule for accidents where you share some of the fault. Nevada uses the modified version (NRS 41.141): you can still recover as long as your negligence was not greater than the negligence of the defendant, or the combined negligence of the defendants you are suing, and your compensation is reduced in proportion to your share of the fault. If your share is greater than theirs, you recover nothing.
Can I claim if the other driver is uninsured?
That depends on your own policy. NRS 687B.145(2) requires an insurer selling motor vehicle insurance in Nevada to offer uninsured and underinsured vehicle coverage in an amount equal to the limits of coverage for bodily injury it sells you under a policy covering the use of a passenger car or motorcycle, and no such offer is required on a general commercial liability, excess or umbrella policy, or another policy that does not provide primary motor vehicle insurance (NRS 687B.145(5)). The coverage must include a provision that lets you recover from your own insurer, up to your own limits, damages for bodily injury you are legally entitled to recover from the owner or operator of the other vehicle, to the extent those damages exceed the bodily injury limits that owner or operator carries. The statute requires the insurer to offer that coverage, not the driver to buy it, and it does not require the insurer to reoffer it on a replacement, reinstatement, substitute or amended policy, so many drivers do not have it. If you carry it, that is usually the route. If you do not, recovery usually depends on a claim against the driver personally and on whether any other party shares responsibility for the crash, and what such a claim is worth turns on what that driver actually has. An attorney can read your policy and tell you which route is open.
