Understanding commercial vehicle accidents
Definition and types of commercial vehicles:
Commercial vehicles are used to transport goods or passengers for business purposes. They come in various forms, each with their unique set of regulations and potential risks on the road. Some common types of commercial vehicles include:
- Trucks (e.g., semi-trucks, delivery trucks, tow trucks)
- Transportation Buses (e.g., city buses, school buses, charter buses)
- Vans and Hotel Shuttles (especially those used for delivery or passenger transport)
- Taxis and rideshare vehicles
- Specialized vehicles (e.g., construction vehicles, agricultural vehicles)
- Emergency Response Vehicles (fire trucks, police, ambulance, etc.)
Common causes of commercial vehicle accidents:
While accidents can happen for myriad reasons, some causes are more prevalent in incidents involving commercial vehicles. A few common causes include:
- Divided Attention: Like any other driver, those behind the wheel of a commercial vehicle can become distracted by phones, radios, or other distractions inside or outside the vehicle.
- Fatigue: Commercial drivers often work long hours and may become fatigued, impacting their reaction times and judgment.
- Inadequate training: Operating a commercial vehicle requires specialized training. Inadequate training can lead to dangerous situations on the road.
- Poor vehicle maintenance or vehicle defects: Given the heavy use, commercial vehicles require regular maintenance. Failing to uphold maintenance standards can result in mechanical failures leading to accidents.
The role of commercial vehicle companies and their responsibilities:
Commercial vehicle companies have a responsibility to ensure the safety of their operations. This includes:
- Hiring qualified and well-trained drivers.
- Ensuring their fleet is well-maintained and safe to operate.
- Adhering to all federal, state, and local regulations governing commercial vehicle operations.
- Implementing and enforcing safety protocols to minimize the risk of accidents.
These responsibilities are not just good practice; they’re often mandated by law. When a commercial vehicle accident occurs, examining the role of the commercial vehicle company is crucial in determining liability and pursuing a claim.
One difference matters before anything else: some of the vehicles above are operated by government and some, including many ambulances, are operated privately under contract. Where the vehicle belonged to the State or a political subdivision, a claim arising from it runs through the statutes at NRS 41.031 to 41.039 rather than the ordinary route, so who owned and operated the actual vehicle is the first thing to establish. NRS 41.031(1) waives the State’s immunity if the claimant complies with the limitations of NRS 41.010 or the limitations of NRS 41.032 to 41.036, inclusive, and except as otherwise provided in NRS 41.032 to 41.038, inclusive, NRS 485.318, subsection 3 and any statute which expressly provides for governmental immunity. NRS 41.036(1) and (2) direct that the tort claim be filed within two years after the cause of action accrues, with the Attorney General for a state claim or with the political subdivision’s governing body; NRS 41.036(3) says that filing is not a condition precedent to bringing an action under NRS 41.031. NRS 41.035(1) caps an award at $200,000, exclusive of interest computed from the date of judgment, to or for the benefit of any claimant, and provides that an award may not include any amount as exemplary or punitive damages. Separate immunities can also apply, including NRS 41.032(2) for discretionary functions and NRS 41.033 for a failure to inspect or to discover a hazard. If a public vehicle was involved, raise it with a lawyer at the first meeting.
Legal aspects of commercial vehicle accidents
Liability considerations:
In commercial vehicle accidents, determining liability can be more complex than in other types of vehicle accidents. Here are the primary parties that may be held liable:
Driver
Company
Manufacturer
Laws and regulations:
Commercial vehicle operations are governed by both federal motor carrier regulations and Nevada traffic law. The federal rules, made by the Federal Motor Carrier Safety Administration, sit in Title 49 of the Code of Federal Regulations: hours of service for property-carrying drivers at 49 CFR 395.3, inspection, repair and maintenance at 49 CFR 396.3, and driver qualification files at 49 CFR 391.51. Which of these rules reach a particular vehicle and trip is one of the first questions in a commercial vehicle case, and it affects what evidence exists and how long it is kept, so raise it with your attorney early.
Importance of evidence and documentation:
Documenting the circumstances surrounding a commercial vehicle accident is pivotal in building a strong case. Here’s what can significantly impact your claim:
Accident reports
Medical records
Witness testimonies
Photos and videos
Company records
Thorough documentation helps in establishing liability and in showing the full extent of your losses. It’s advisable to consult with an lawyer experienced in commercial vehicle accidents to guide you through this process.

(702) 633-3333 Free consultation · Available 24/7 Or send us the details onlineWhat makes commercial vehicle accidents unique compared to personal vehicle accidents?
Commercial vehicle accidents tend to be more complex due to multiple liable parties like the driver, company, or manufacturer, and are governed by specific laws and regulations. The damages can also be more severe due to the size and weight of commercial vehicles.
Why is legal expertise crucial in handling commercial vehicle accident claims?
Legal expertise is essential to navigate the complex laws, gather crucial evidence, negotiate with insurance companies, and pursue any compensation that may be available under the facts and the law, especially given the multiple parties involved in commercial vehicle accidents.
How should one proceed immediately after a commercial vehicle accident?
It’s advisable to document the scene, gather eyewitness statements, seek medical attention immediately, and engage with an experienced attorney early to guide through the claim process and avoid common mistakes.
What are the laws governing commercial vehicle operations in Nevada?
Two bodies of law can apply. The Federal Motor Carrier Safety Administration’s rules sit in Title 49 of the Code of Federal Regulations and cover matters such as maximum driving time for property-carrying drivers (49 CFR 395.3), inspection, repair and maintenance (49 CFR 396.3) and driver qualification files (49 CFR 391.51). Nevada traffic law applies alongside them. Which rules govern a particular vehicle and trip is a question for your attorney, and a violation of one of them can be evidence of negligence rather than a claim you bring under the regulation itself.
How does the liability of a commercial vehicle company differ from that of the driver?
The company may be held liable for negligence in hiring, training, or maintenance, while the driver’s liability might arise from negligent or reckless driving.
Can the manufacturer of a commercial vehicle be held liable in an accident?
Yes, if it’s proven that a manufacturing defect contributed to the accident, the manufacturer could be held liable.
What types of compensation are available in commercial vehicle accident claims?
Compensation can cover medical expenses, lost wages, pain and suffering, and property damage. Punitive damages are also possible, but only where clear and convincing evidence shows the defendant acted with oppression, fraud or malice, and unless an exception in the statute or another specific statute applies, NRS 42.005 limits such an award to three times the compensatory damages, or $300,000 if those are under $100,000.
What challenges can one expect in insurance negotiations following a commercial vehicle accident?
Insurance companies might try to minimize payouts, and the presence of multiple insurance policies can complicate negotiations.
How long does it typically take to settle a commercial vehicle accident claim?
The timeline varies based on the complexities of the case, the extent of injuries, and the negotiation process with insurance companies, it can range from months to years.
